NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Braxton County Commission.

 

REQUEST FOR RELEASE OF FUNDS

 

On or after October 30, 2025, the Braxton County Commission will submit a request to HUD for the release of Community Project funds under FY2024 Community Project Funding of the Consolidated Appropriations Act of 2024, as amended, to undertake the following project:

 

Project Title: Holly Gray Park Pavilion Replacement

 

Purpose: Funds will be used to construct a new 4,250 square-foot dining hall to accommodate approximately 125 4-H campers. The dining hall will include a full commercial kitchen and will also be available for use by non-4H activities such as wedding receptions, reunions, educational programs, community events, etc. If funds allow, the dining hall will also have a covered outdoor patio and fire pit. The project will include water and sewer connections to existing and planned water and sewer service provided by the local public service district.

 

Location: Holly Gray Park, Sutton, WV 26601

 

Estimated Cost: $1,590,000 total ($1,500,000 in HUD funding and $90,000 in county ARPA funds)

 

FINDING OF NO SIGNIFICANT IMPACT

 

The Braxton County Commission has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Braxton County Commission’s Office within the Braxton County Courthouse at 300 Main Street, Sutton, WV 26601 and Region VII Planning & Development’s Office at 21 E. Main St, Suite 102, Buckhannon, WV 26201 and may be examined or copied weekdays 8 A.M to 4 P.M.

 

PUBLIC COMMENTS

 

Any individual, group, or agency may submit written comments on the ERR to the Region VII Planning and Development Council via email to [email protected] or USPS to Carrie Wallace at 21 E. Main St., Suite 102, Buckhannon, WV 26201. All comments received by October 29, 2025, will be considered by the Braxton County Commission prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

 

RELEASE OF FUNDS

 

The Braxton County Commission certifies to HUD that Lisa Godwin in her capacity as Commission President consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Braxton County Commission to use HUD program funds.

 

OBJECTIONS TO RELEASE OF FUNDS

 

HUD will accept objections to its release of fund and the Braxton County Commission’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Braxton County Commission; (b) the Braxton County Commission has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at 451 7th Street S.W., Washington, D.C. 20410-1000. Potential objectors should contact HUD to verify the actual last day of the objection period.
