NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND
NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Tucker County Commission.
REQUEST FOR RELEASE OF FUNDS
On or after October 30, 2015, the Tucker County Commission will submit a request to the West Virginia Development Office for the release of U.S. Department of Housing and Urban Development Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), as amended to undertake the following project:
Project Title: Hamrick PSD Water Distribution System Upgrade and Waterline Extension
Purpose: The project will extend water service to the Location Road area of Tucker County. In addition, the project will make upgrades to Hamrick PSD’s existing system, which will consist of painting a 200,000 gallon water storage tank, replacing service lines in the St. George and Holly Meadows communities and increasing the capacity of the Hamrick PSD’s water treatment plant.
Location: The project will serve the communities of Holly Meadows, St. George, Location Road and Hendricks in rural Tucker County.
Estimated Cost: The total estimated cost is $6,250,000.00, with Community Development Block Grant Program funds contributing $1,500,000 of that.
FINDING OF NO SIGNIFICANT IMPACT
The Tucker County Commission has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record on file at the Tucker County Commission Office, 211 First Street, Suite 307, Parsons, WV 26287, and may be examined or copied weekdays from 8:30 A.M. to 4 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the Tucker County Commission. All comments received by October 29, 2015 will be considered by the
Tucker County Commission prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The Tucker County Commission certifies to the West Virginia Development Office that Lowell Moore in his capacity as Commission President consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The West Virginia Development Office approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Tucker County Commission to use HUD program funds.
OBJECTIONS TO RELEASE OF FUNDS
The West Virginia Development Office will accept objections to its release of funds and the Tucker County Commission’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Tucker County Commission; (b) the Tucker County Commission has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs, or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the West Virginia Development Office; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be address to the West Virginia Development Office at Building 6, Room B-553, 1900 Kanawha Blvd. SE, Charleston, WV 25305. Potential objectors should contact the West Virginia Development Office to verify the actual last day of the objection period.
