NOTICE OF HEARING IN THE CIRCUIT COURT OF RALEIGH COUNTY, WEST VIRGINIA IN RE: PETITION OF APPALACHIAN AGGREGATES, LLC FOR THE TRANSFER OF REMAINS IN GRAVESITES LOCATED UPON PRIVATELY OWNED LANDS CIVIL ACTION NO. 16-C-664 To any persons who claim or may claim to be surviving decedents, next of kin, heirs at law, administrators, executors, or personal representatives of any deceased person interred at an unnamed cemetery situated upon certain real property located at or around 1700 North Sandbrach Road, Mount Hope, West Virginia, said property being privately owned by Appalachian Aggregates, LLC and being of record in Deed Book 5042, Page 9979 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, a Petition has been filed by Appalachian Aggregates, LLC with the Circuit Court of Raleigh County, West Virginia requesting authority, pursuant to West Virginia Code c?37-13-1, et seq., to transfer, relocate, and re-intern gravesites and remains discovered within the unnamed cemetery another location on the same real property owned by Appalachian Aggregates, LLC. This matter is scheduled for hearing before the Honorable Robert A. Burnside, Judge of the Circuit Court of Raleigh County, West Virginia, at 10:30 a.m. on Wednesday, November 9, 2016, in Courtroom 3 of the Raleigh County Courthouse, 222 Main Street, Beckley, West Virginia 25801. You are required to attend this hearing if you desire to claim any interest in the gravesites or remains contained therein as a surviving decedent, next of kin, heir at law, administrator, executor, or personal representative of any deceased person interred at the unnamed cemetery. If you plan to attend the hearing for purposes of opposing the Petition, please be prepared to provide evidence of ancestry or relation to any deceased person interred within the cemetery.
