NOTICE OF PUBLIC HEARING

NOTICE OF PUBLIC HEARING ON BOND AUTHORIZING ORDINANCE OF THE FAYETTE COUNTY BUILDING COMMISSION A public hearing will be held on the following entitled Ordinance at a special meeting of the Building Commission of Fayette County (the “Building Commission”) to be held on Wednesday, May 27, 2015, at 12:00 p.m. at the County Commission Chambers at 100 Court Street, Fayetteville, West Virginia, and at such hearing any person interested may appear before the Building Commission and present protests, and all protests and suggestions shall be heard by the Building Commission and it shall then take such actions as it shall deem proper in the premises upon an Ordinance entitled: BOND AUTHORIZING ORDINANCE OF FAYETTE COUNTY BUILDING COMMISSION AN ORDINANCE AUTHORIZING THE ADVANCE REFUNDING OF THE FAYETTE COUNTY BUILDING COMMISSION LEASE REVENUE BONDS, SERIES 2011 MATURING AFTER OCTOBER 1, 2016; THE ISSUANCE OF THE FAYETTE COUNTY BUILDING COMMISSION LEASE REFUNDING REVENUE BONDS, SERIES 2015, IN THE AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $2,500,000, THE PROCEEDS OF WHICH SHALL BE EXPENDED TO PROVIDE FUNDS TO ADVANCE REFUND THE CALLABLE 2011 BONDS AND TO PAY COSTS IN CONNECTION WITH THE ISSUANCE OF SUCH BONDS; AUTHORIZING THE EXECUTION AND DELIVERY OF A TRUST INDENTURE, A LEASE AGREEMENT, A LEASE ASSIGNMENT, A CREDIT LINE DEED OF TRUST, FIXTURE FILING AND SECURITY AGREEMENT, A BOND PURCHASE AGREEMENT, A CONTINUING DISCLOSURE AGREEMENT, AN ESCROW AGREEMENT; AND OTHER DOCUMENTS FOR SUCH BONDS; APPROVING A PRELIMINARY OFFICIAL STATEMENT AND AUTHORIZING AN OFFICIAL STATEMENT WITH RESPECT TO THE SERIES 2015 BONDS; PROVIDING PARAMETERS FOR ESTABLISHING THE PRINCIPAL AMOUNTS, MATURITIES, INTEREST RATES, PROVISIONS FOR REDEMPTION AND OTHER TERMS OF THE SERIES 2015 BONDS; APPOINTING THE CHAIRMAN AS THE REPRESENTATIVE OF THE BUILDING COMMISSION TO APPROVE THE FINAL TERMS AND PRICING OF THE SERIES 2015 BONDS WITHIN SUCH PARAMETERS AND THE FINAL FORMS OF THE BOND DOCUMENTS PURSUANT TO A CERTIFICATE OF DETERMINATIONS; APPOINTING OTHER PERSONS OR ENTITIES RELATING TO THE ISSUANCE OF THE SERIES 2015 BONDS; AUTHORIZING AND DIRECTING THE EXECUTION AND DELIVERY OF THE SERIES 2015 BONDS; AND AUTHORIZING OTHER MATTERS, THE EXECUTION AND DELIVERY OF ALL OTHER DOCUMENTS AND THE TAKING OF ALL OTHER ACTIONS RELATING TO SUCH FINANCING THEREOF. The above quoted title of the Ordinance describes generally the contents thereof and the purposes of the Bonds contemplated thereby. The Building Commission contemplates the issuance of the Bonds described in the Ordinance. The proceeds of the Bonds will be used to (i) advance refund the Callable 2011 Bonds, and (ii) pay costs of issuance of the Series 2015 Bonds and related costs. The Bonds are payable from the revenues derived from the Lease Rentals paid by the County Commission. No taxes may at any time be levied for the payment of the Bonds or the interest thereon. The above-entitled Ordinance was adopted by the Fayette County Building Commission on April 14, 2015. A certified copy of the above entitled Ordinance is on file with the County Commission for review by interested parties during regular office hours.
