NOTICE OF PUBLIC HEARING
AN ORDINANCE TO INCREASE THE PENALTY FOR DISPOSING OF WASTE FROM OUTSIDE TAZEWELL COUNTY AT THE TAZEWELL COUNTY LANDFILL OR A TAZEWELL COUNTY
CONVENIENCE AREA
PLEASE TAKE NOTICE that the Board of Supervisors of Tazewell County, Virginia, will conduct a public hearing on August 4, 2020 at 6:30 PM, or as soon thereafter as may be practical, at the Tazewell County Administration Building, located at 197 Main Street, Tazewell, Virginia 24651, and hereby gives its intent to adopt a An Ordinance to Increase the Penalty for Disposing of Waste from Outside Tazewell County at the Tazewell County Landfill or a Tazewell County Convenience Area.
Pursuant to Section 17-135 of the Tazewell County Code of Ordinances, it is unlawful for any person to dispose any garbage, trash, refuse, or solid or hazardous waste from outside Tazewell County into the Tazewell County Landfill or one of Tazewell County’s convenience areas (collection sites). Pursuant to Section 17-133 of the Tazewell County Code of Ordinances, such action is punishable by penalty of one thousand dollars ($1,000.00) and up to twelve (12) months’ imprisonment. As the illegal disposal of waste has increased in Tazewell County, the Board of Supervisors seeks to increase the penalty to a Class 1 misdemeanor, being a fine of two thousand, five hundred dollars ($2,500.00) and/or twelve (12) months’ imprisonment, pursuant to Section 15.2-1429 of the Code of Virginia (1950), as amended.
All persons wishing to comment on the proposed Ordinance are hereby invited to attend and state their views thereon. A notification of five (5) working days before the meeting will enable the County Administrator’s Office to make reasonable arrangements to ensure accessibility to the meeting.
