NOTICE OF PUBLIC HEARING
FORMATION OF A NEW PUBLIC SERVICE DISTRICT,
TO BE KNOWN AS MERCER COUNTY PUBLIC SERVICE DISTRICT

Please take notice that the Mercer County Commission shall bring on for public hearing at the Mercer County Commission Offices, located in the Mercer County Courthouse at 1501 Main Street, Princeton, West Virginia, on March 12, 2019, at 10:00 a.m., a Motion to Establish a New Public Service District, which said new public service district shall be known as “Mercer County Public Service District.”
The Mercer County Commission continues to consider the needs of County residents for essential infrastructure of water and sewer utility service. There exists now an urgent need in the Matoaka area for an operational organization to replace the Matoaka municipal sewer services to residents now receiving sewer service, and the Town of Matoaka is ceasing all municipal activity, including the operation of the sewer plant for its treatment and collection system. Other areas of Mercer County outside of established municipalities and public service districts that provide water and sewer service need these essential services. By establishing a countywide public service district that will serve all areas not currently being served by other municipal and public service utilities, the Commission believes this public service district will be responsive to the needs of those areas that do not now have such utilities or are not within areas where such utilities are immediately planned. The Commission believes that a countywide public service district is better suited to respond to the needs of County residents than the Commission acting to install and operate such facilities pursuant to West Virginia Code 7-1-3a.
Pursuant to West Virginia Code 16-13A-2, the Mercer County Commission moves
to create a countywide public service district to be known as the Mercer County Public Service District. This Public Service District will have both water and sewer service authority.

The territory of the Mercer County Public Service District shall be described as:

The entire territory of the boundary of Mercer County, West Virginia, authorized in West Virginia Code 1-1-1 as bounded by the Commonwealth of Virginia, McDowell County, Wyoming County, Raleigh County, Summers County and Monroe County, West Virginia, excepting and reserving territory of another utility service provider, including the following: Town of Athens -water and sewer; City of Bluefield – water and sewer; City of Princeton -water and sewer; Bramwell Public Service District -sewer; Bluewell Public Service District-water and sewer; Cool Ridge-Flat Top Public Service District -water; Cumberland Public Service District – water; Green Valley/Glenwood Public Service District -water and sewer; Lash meet Public Service District -water; Oakvale Road Public Service District -water and sewer.

Notices of this public hearing shall be set, posted, and published; and the Public Service Commission of West Virginia shall be notified within 10 days of the public hearing being set.
Any person having comments, questions or who wishes to speak in favor of or in opposition to the formation of a public service district to be known as the “Mercer County Public Service District” should appear at that place and time.
