NOTICE OF PUBLIC SALE AND AUCTION OF MUNICIPAL REAL PROPERTY CITY OF MONTGOMERY, W.VA. Pursuant to W.Va. Code 8-12-18, Notice is hereby given that the following described properties or lots of land located in the City of Montgomery, West Virginia ("City") and Counties of Fayette & Kanawha, have been certified for sale by auction by the City. The properties will be offered for sale to the highest eligible bidder through submission of sealed bids. A deposit in the amount of ten percent (10%) of the successful bid must be paid within 5 business days of acceptance of the bid by City The balance of the purchase price must be paid within thirty (30) days following acceptance of the bid by the City Council. Payments must be made by certified check, cashier's check, or money order payable to the City of Montgomery. All properties are sold AS IS, WHERE IS, with no warranties, express or implied, as to condition, title, zoning, or suitability for any particular purpose, and will be transferred by quitclaim deed. Any bidder who is currently the subject of any City code enforcement action and/or who is delinquent in payment of City taxes, fees, or other debts due City shall not be considered an eligible bidder. The City of Montgomery reserves the right to reject any and all bids for any lawful reason.
