NOTICE OF PROPOSED SALE OF REAL ESTATE BY TRUSTEES
OF THE FIRST BAPTIST CHURCH OF FAIRMONT
To the members of the congregation of the First Baptist Church of Fairmont, West Virginia.
NOTICE is hereby given as required by Chapter 35, Article 1, Section 10 of the
Code of West Virginia, as amended, that on or after the 3rd day of December, 2015, the undersigned Trustees of the First Baptist Church of Fairmont, Fairmont, Marion County, West Virginia propose to sell to Fairmont Enterprises, LLC, at an agreed upon price and on the terms herein-after stated, that certain parcel of real estate located in the City of Fairmont, Fairmont District, Marion County, West Virginia, to-wit:
All of that certain tract or parcel of real estate being all of Lot 3 and parts of Lots 4 and 6 , Tract No.’s 1 and 8 of the Harr Addition of Fairmont Farms as shown on plats of record in Deed Book 376, Page 447, Deed Book 361, Page 233 and Deed Book 634, Page 24, lying and being in the City of Fairmont, Marion County, West Virginia, more particularly described as follows:
Beginning at a 5/8″ iron pin set on the western r/w limits of Fairmont Avenue, corner to Lots 2 and 3 of Tract No. 8; thence with one line of Lot 2 N 62° 56′ 00″ W 115.00 feet to a 1″ square rod found, corner to Lots 2, 3, 4 and 5 of Tract No. 8; thence with one line of Lots 4 and 5
N 62° 56′ 00″ W 14.85 feet to a 5/8″ iron pin set in line of Lots 4 and 5; thence with a new division line through Lot 4 of Tract No. 8 N 24° 41′ 00″ E 65.00 feet to a 1″ iron pin found, corner to Lots 5 and 6 of Tract No. 1; thence with line of Lots 5 and 6 of Tract No. 1 N 27° 04′ 00″ E 18.09 feet to a 5/8″ iron pin set in line of Lots 5 and 6 of Tract No. 1; thence with a new division line through Lot 6 of Tract No. 1 S 62° 56′ 00″ E 129.10 feet to a track spike set on the western r/w limits of Fairmont Avenue; thence with the western r/w limits of Fairmont Avenue S 24° 41′ 00″ W 83.10 feet to the place of beginning, containing 0.25 acres, more or less as shown on plat prepared by Paul D. Harbert, PS No. 862 of McCoy Land Surveying dated October 2015, attached hereto and made part of this description.
Being part of the same tracts or parcels of real estate conveyed unto Trustees of the First Baptist Church of Fairmont by deed dated 23rd day of October, 1969, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia in Deed Book 742 at Page 85. Said tracts or parcels of real estate is assessed upon the Land Books for the City of Fairmont, and is more specifically shown on Tax Map 15 as Parcels 7 and 8.
It is understood and agreed that the twenty (20) foot private road, street or driveway between Lot No. 7 on the western side thereof and Lot Nos. 4, 5 and 6 on the eastern side thereof, as shown on said plat of sub-division of Tract No. 8, Fairmont Farms, of record in said Marion County Clerk’s Office in Deed Book No. 365, at Page No. 577, shall always be kept open for purposes of ingress to and egress from said Lot Nos. 4, 5, 6 and 7, and to be enjoyed equally by the adjoining owners thereof, their heirs, successors and assigns.
Said real estate described above is proposed to be sold by the Trustees to Fairmont Enterprises, LLC for the sum of One Hundred Thousand Dollars ($100,000.00).
The Church will hold a Special Business meeting on Sunday, November 22, 2015, prior to regular services, wherein this Notice will be read and discussed by the congregation. The Notice will be re-read and discussed the following Sunday, on November 29, 2015, after which the congregation shall vote to approve or deny the proposed sale. All members of the Church may attend, voice their opinion, and vote.
If the proposed action by the undersigned Trustees is approved pursuant to the authority given by the congregation of the First Baptist Church of Fairmont, by the affirmative vote of more than two-thirds (2/3) of the qualified members present over eighteen (18) years of age, at the Special Business Meetings of said Church duly called and held at the said Church on Sunday, November 22, 2015, and Sunday, November 29, 2015, at which meetings more than the necessary forum shall be present, the Trustees will adopt a resolution confirming the sale and further complete the sale transaction.
