NOTICE OF SALE BY TRUSTEE UNDER DEED OF TRUST Pursuant to the authority granted in the certain Deed of Trust from David Scott Worley and Cynthia Lee Martin Worley, husband and wife, dated August 25, 2004 to Trilla Wills, Trustee, to secure Woodrow. W. Naff, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Book 5014, at page 8606, and default having been made by the said David Scott Worley and Cynthia Lee Martin Worley in the payment of the obligation secured by said Deed of Trust and sale having been requested in writing by the beneficial holder of the obligation secured, the undersigned will offer for sale at the main door of the RALEIGH COUNTY COURTHOUSE, 215 MAIN STREET, BECKLEY, WEST VIRGINIA, at 10:00 a.m. on the 21st day of September, 2015, that certain described surface property, together with the improvements thereon and appurtenances thereto belonging, situate in or near the Town of Mt. Tabor, Town District, Raleigh County, West Virginia, and more particularly described as follows: BEGINNING at a stone gatepost, the northeast corner of the Calfee Brothers Cemetery and the southeast corner of the Holdren 6.70 – acre tract, which beginning point is 15 feet west of the center of the road from West Virginia Route 3 southward toward Mt. Tabor; thence in the western direction along the Calfee line 184 feet, more or less, to a post, a corner to said Calfee Brothers lot and the property of Orville Williams to the west thereof; thence following the Williams line in a westerly direction 341 feet, more or less, to a stone, a corner to the Pearl Stanley tract of land now owned by Richard Gillespie and Mary K. Gillespie, his wife; thence in a northerly direction following the Pearl Stanley line 130 feet to a concrete corner block; thence leaving the Gillespie line and in an easterly direction through the Holdren 6.70 – acre tract approximately 470 feet to a concrete corner block in the eastern boundary of 6.70 – acre Holdren tract and said Mt. Tabor road; thence along the western edge of said Mt. Tabor road in a southerly direction approximately 137 – 1/2 feet to the point and place of beginning, containing 1.52 acres, more or less, as shown on that map dated Sept. 8, 1965, entitled “Map of Surface Tract 6.70 Acres More or Less C. R. Holdren and Annie Holden…” of record with a deed in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 443, at Page 356. And being the same property conveyed to the said David Scott Worley and Cynthia Lee Martin Worley from Woodrow W. Naff, a widower, by Deed dated August 25, 2004 and recorded in the aforesaid Clerk’s Office in Book 5014, at page 8605. Under the provisions of the aforementioned Deed of Trust, the beneficial holder is entitled to appoint a Substitute Trustee. The beneficial holder, the Estate of Woodrow Wilson Naff, exercised said power by Appointment of Substitute Trustee dated June 4, 2015 and of record in the aforesaid Clerk’s Office in Book 5059, at page 351, appointing the undersigned Substtitute Trustee in the place and stead of the said Trilla Wills. The above described property will be conveyed by the undersigned to the purchaser by deed without warranty of any kind, express or implied, and will be made subject to all property taxes, prior liens, including any liens for sewer services assessed by any municipality or public service district, reservations, encumbrances, restrictions, rights of way, easements, covenants, charges and conditions of record in the aforesaid Clerk’s Office affecting the subject property, including but not limited to those reservations and exceptions set forth in the above referenced Deed. The subject property will be sold in “AS IS” condition. The undersigned shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. The subject property is reported to have a street address of Mount Tabor Road, Beckley, West Virginia 25801. This sale is made subject to redemption rights of the United States pursuant to USC Title 26 Section 7425, by virtue of an Internal Revenue Service lien placed against the subject property.
