NOTICE OF SALE BY TRUSTEE UNDER DEED OF TRUST Pursuant to the authority granted in that certain deed of trust from Teresa L. McMillion dated May 25, 1998 to Edgar E. Bibb, III and Carroll D. Simpkins, Trustees, to secure William G. Dancy, and of record in the office of the Clerk of the County Commission of Fayette County, West Virginia in Trust Deed Book 346, at page 391, and default having been made by the said Teresa L. McMillion in the payment of the obligation secured by said deed of trust and sale having been requested in writing by the beneficial holder of the obligation secured, the undersigned will offer for sale at the main door of the FAYETTE COUNTY COURTHOUSE, 100 COURT STREET, FAYETTEVILLE, WEST VIRGINIA, at 10:00 a.m. on the 26th day of January, 2015, the following described property, together with the improvements thereon and appurtenances thereunto belonging, situate in the City of Oak Hill, Fayette County, West Virginia, more particularly described as follows: All that certain lot, tract, or parcel of land, together with the improvements thereon and all appurtenances thereunto belonging, or in any way appertaining, located in the City of Oak Hill, Plateau District, County of Fayette, and State of West Virginia, and more particularly bounded and described as follows: BEGINNING at a stake in line of Rogers (formerly Breneman) corner to Weaver, thence leaving said line and running with Weaver, and Weatherford, an Eastern direction about 326 feet to a gate post on a street, and corner to Weatherford; thence with said Street line S 3905 W 139 feet to a stake; thence leaving said street, and running a western direction about 328 feet to a take in line of the aforesaid Rogers; and with Rogers N 38 15 E 139 feet to the beginning, containing 1.04 acres; more or less. THERE IS EXCEPTED, however, from this conveyance, the .47 acre conveyed by C R Weatherford and wife to J W Childers by deed dated July 17, 1928, and of record in said Clerk’s Office in Deed Book 69, at page 408. And being the same property acquired by the said Teresa L. McMillion by deed from William G. Dancy and Jane C. Dancy, dated April 8, 1998 and of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia in Deed Book 550, at page 124. The above described property will be conveyed by the undersigned to the purchaser by deed without warranty of any kind, express or implied, and will be made subject to all property taxes, prior liens, including any liens for sewer serves assessed by any municipality or public service district, reservations, encumbrances, restrictions, rights of way, easements, covenants, charges and conditions of record in the aforesaid Clerk’s Office affecting the subject property, including but not limited to those reservations the exceptions set forth in the above referenced deed. The subject property will be sold in “AS IS” condition. The undersigned shall be under not duty to cause any existing tenant or person occupying the subject property to vacate said property. The subject property is reported to have a street address of 250 Sanford Street, Oak Hill, West Virginia 25901. TERMS OF SALE Cash in hand on day of sale. The above described real estate will be sold by auction to the highest bidder, subject to the right of the undersigned to reject any and all bids, if, in his opinion, it is or they are inadequate. The owner of the indebtedness secured by the above described deed of trust and the owner of any other interest in the property to be sold shall have a right to bid.. CONTINUANCE – ADJOURNMENT OF SALE The undersigned reserves the right to continue the sale, or to adjourn the sale, for a time, or from time to time without further notice than announcement at the time and place of sale as hereinabove set forth or any continuance or adjournment thereof.
