NOTICE OF SALE BY TRUSTEE UNDER DEED OF TRUST Pursuant to the authority granted in that certain deed of trust dated December 5, 2008 from Debra A. O’Dell and Jonathan T. O’Dell to P. Michael Pleska and F. Thomas Graff, Jr., trustees to secure United Bank, Inc. and recorded in the office of the Clerk of the County Commission, Raleigh County West Virginia at Book 5033, page 9224, default having been made by the said Debra A. O’Dell and Jonathan T. O’Dell in the payment of the obligation secured by said Deed of Trust and having been requested in writing by the holder of the obligation secured, the undersigned will offer for sale at the front door of the Raleigh County Courthouse, 215 Main Street, Beckley, West Virginia, at 10:00 a.m. on Tuesday, June 9, 2015, that certain real estate conveyed by said deed of trust and more particularly described as follows: The surface of the following described lots or parcels of land situate in Blue Jay, Shady Spring District, Raleigh County, West Virginia, and more particularly described as follows: BEGINNING at a stake in line of E. J. Fourney, thence with said line N 71-50′ W 132.26 feet to a stake; thence leaving E. J. Fourney line N 11-15′ W 190.88 feet to a fence post; thence S 56-43′ E 174.68 feet to a fence post in line of Mrs. Lynch, thence with said line S 23-30′ E 144.53 feet to the beginning containing one half acre more or less. And being the same property acquired by Jonathan T. O’Dell and Debra A. O’Dell, his wife, by deed dated August 2, 2000 from Earl Shrewsbury and Helen B. Shrewsbury, his wife, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 5002, at Page 8316. Under the provision of said deed of trust, the beneficial holder reserved the right to appoint a substitute trustee and the beneficial holder, United Bank, Inc., exercised said power by Appointment of Substitute Trustee dated the 25th day of February, 2013, and of record in the aforesaid Clerk’s office at Roll 5050, Page 5160, appointing the undersigned substitute trustee in the place and stead of the said P. Michael Pleska and F. Thomas Graff, Jr. The above described property will be conveyed by the undersigned to the purchaser by deed without warranty of any kind, express or implied, and will be made subject to all property taxes, prior liens, including any liens for sewer services assessed by any municipality or public service district, reservations, encumbrances, restrictions, rights of way, easements, covenants, charges and conditions of record in the aforesaid Clerk’s Office affecting the subject property. The subject property will be sold in “AS IS” condition. The undersigned shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
