IN THE CIRCUIT COURT OF FAYETTE COUNTY, WEST VIRGINIA CIVIL ACTION NO. 15-C-294 (H) EDWARD LEROY BOSLEY, EXECUTOR OF THE LAST WILL AND TESTAMENT OF JESSIE HARRISON SCRUGGS, PLAINTIFF, VS. VIRGINIA COLE, EDWARD LEROY BOSELY, the UNKNOWN HEIRS-AT-LAW, DEVISEES, SUCCESSORS OR ASSIGNS OF JESSIE HARRISON SCRUGGS, and any PERSON or PERSONS CLAIMING TO BE THE PRIMARY CARETAKER OF JESSIE HARRISON SCRUGGS, DECEASED. DEFENDANTS. ORDER OF PUBLICATION The object of the matter pending in above entitled action is a Complaint for Declaratory Judgment requesting that the Court determine by means of a Declaratory Judgment that the Defendants, Virginia Cole and Edward Leroy Bosley, were the “primary caretakers” of Jessie Harrison Scruggs at the time of his death on May 21, 2014, as contemplated under the terms of the Last Will and Testament of Jessie Harrison Scruggs recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia. Based upon the sworn verification of the Plaintiff contained in the Complaint for Declaratory Judgment that there are or may be persons other than those named in said Complaint as Plaintiff and Defendants, interested in the subject matter of the action, whose names are unknown to the Plaintiff and who are made Defendants by general description, and who may be non-residents of the State of West Virginia, it is hereby ORDERED that said Defendants, Virginia Cole, Edward Leroy Bosley, the unknown heirs-at-law, devisees, successors or assigns of Jessie Harrison Scruggs, and any person claiming to be the primary caretaker of Jessie Harrison Scruggs at the time of his death on May 21, 2014, do appear and serve upon James C. Blankenship, III, Attorney at Law, P.O. Box 326, Fayetteville, WV 25840, an answer or other defense to the this action on or before thirty (30) days from the date of the first publication of this Class II Order of Publication, otherwise judgment by default will be taken against said Defendants at any time thereafter. A copy of the Complaint for Declaratory Judgment may be obtained from the undersigned Clerk at his office located on the second floor of the Fayette County Courthouse, in Fayetteville, West Virginia.
