Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on
March 10, 2015
11:00 a.m.
offer for sale certain property described in that certain deed of trust executed by Starlette A. Fetty, to David E. Thompson and Rudy F. Torjak, Jr., as Trustees, which deed of trust is described as bearing date the 14th day of August, 2008, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 447, at Page 80, and given to secure Citizens National Bank of Elkins (now known as Citizens Bank of West Virginia), the payment of a note therein described. Said property is described as follows:

Two lots situate on the east side of West Virginia Secondary Route 18/1 in Roaring Creek District, Randolph County, and more particularly described as follows:

Tract One: Beginning at an iron rod located on the east right of way of West Virginia Secondary Route 18/1, a corner with Western Maryland; thence with the Western Maryland line, N 66 06 E 893.9 feet to an iron rod, a corner with Arthur Rhodes, thence with the Arthur Rhodes line N 35 30 W 108.0 feet to an iron rod, a corner with Lot 2; thence with Lot 2 S 70 34 E 199.4 feet to the beginning, containing 3.0 acres, as shown as “Lot 1” on a plat of survey of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 466, at Page 203.

Tract Two: Beginning at an iron rod located on the east side of West Virginia Secondary Route 18/1, a corner to Lot 1; thence with Lot 1 reserved N 70 34 E 959.7 feet to an iron rod located on the Arthur Rhodes line; thence two (2) lines with Arthur Rhodes N 35 30 W 30.6 feet, N 60 W 80.0 feet to an iron rod, a corner to Lot 3; thence with Lot 3 S 76 34 W 961.2 feet to an iron rod located on the east side of West Virginia Secondary Route 18/1; thence with the east side of said route S 36 E 198.9 feet to the beginning, containing 3.01 acres, as shown as “Lot 2” on aforesaid plat.

And being the same real estate conveyed to Matthew Fetty and Starlette A. Fetty, by virtue of a deed from Roy G. Elmore and Sandra K. Elmore, dated May 21, 1999, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 466, at Page 200. The said Matthew Fetty died September 20, 2006, and pursuant to the survivorship clause in said deed, title to said real estate vested in the survivor, Starlette A. Fetty.
By Substitution of Trustee dated the 9th day of February, 2015, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 532, at Page 115, Jennifer L. Morgan was appointed Substitute Trustee.
The above described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes.
TERMS OF SALE: Ten Percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) Cash in hand on day of sale, with the remaining balance due within thirty (30) days.
The undersigned Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
