NOTICE OF SPECIAL
COMMISSIONER’S SALE
Under authority of the order of the Honorable Paul M. Blake, Jr., Judge of the Circuit Court of Fayette County, West Virginia, entered February 21, 2018, in the matter of McCune v. Tomlin, et als., Civil Action No. 17-C-325(B), the undersigned Special Commissioner appointed by the Court pursuant to said authority given, will, on Thursday, August 9, 2018, at 10:00 a.m., at the front door of the Fayette County Courthouse, located at Fayetteville, Fayette County, West Virginia, offer for sale the following tracts or parcels of surface land, together with the improvements thereon, appurtenances thereunto belonging and rights incidental thereto: New Haven District Tax Map 32, parcel 46, with such property consisting of a residence and approximately 24.43 acres, Fayette County Assessor Account Number 06200816.
And further being a portion of the two surface tracts described in a deed of record with the Clerk of the County Commission for Fayette County, West Virginia, in Deed Book 311, at page 492, with the preceding tracts being subject to two out conveyances as set forth in deeds of record with the aforesaid Clerk’s office as follows: out conveyance of approximately six acres, Deed Book 607, at page 61; and, out conveyance of approximately 11.11 acres in Deed Book 665, at page 713.
The above described and/or referenced tracts or parcels of surface land shall be conveyed by the undersigned Special Commissioner to the purchaser by a deed without warranty of any kind, express or implied, and made subject to all property taxes, prior liens, including any liens for sewer service assessed by any municipality or public service district, reservations, encumbrances, restrictions, rights of way, easements, covenants, conveyances and conditions of record in said Clerk’s office and affecting the subject property.
The property is to be sold in AS IS condition.
The Special Commissioner shall be under no duty to cause any existing co-tenant, tenant or other person occupying the subject property to vacate said property.
TERMS OF SALE: Cash in hand on day of sale.
The above real estate will be sold by the Special Commissioner at the auction to the highest bidder subject to the right of the Circuit Court of Fayette County, West Virginia, to approve or reject all bids. Ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) percent of the purchase price shall be paid to the Special Commissioner to be held in trust from the date of the sale and the balance must be available on the date the matter is presented to the Court for approval or rejection of sale.

ADJOURNMENT OF SALE:
The undersigned Special Commissioner reserves the right to continue the sale or to adjourn the sale, for a time, or from time to time, without further notice by an announcement at a time and place of the sale as hereinbefore set forth for any continuance or adjournment thereof.
