4 .15 acres and O. 41 acres, more or less, Kegley, Rock District, (Tax Map 39, Parcel 0087.0001 and 0087.0008), Mercer County, West Virginia

Upon notification by the holder of a Note secured by the Deed of Trust described below of a default and having been requested to institute these proceedings, and by virtue of the authority vested in us under that certain Deed of Trust dated the 5th day of September, 201 7, executed by Steven Dunn unto D. W. Barie and Gerald Manning, as Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1377, at Page 583, and pursuant to a Substitution of Trustee, dated October 15, 2019, by which Phillip B. Ball and Gregory K. Ball were substituted as trustees in place and stead of the said D. W. Barie and Gerald Manning, and which said Deed of Trust secured Danny Dunn, we will
ON THE 9th DAY OF DECEMBER, 2019, AT 10:00 O’CLOCK A.M., at the front door of the Mercer County Courthouse (being the North Walker Street side) at Princeton, Mercer County, West Virginia, offer for sale at public auction to the highest bidder, the following residential property, to-wit:
the following described real estate situate in Rock District, Mercer County, West Virginia and more particularly bounded and described as follows:
“BEGINNING at the Northwest corner of the Kegley School Lot said corner being an iron pin beside a fence post, and running down the hill N. 5deg. 28′ W. 335.5 feet to a stake in the Right of Way line of the Virginian Railroad; thence with the said railroad right-of-way, following a fence, S. 64deg. 11′ W. 128.7 feet; S. 63deg. 06′ W. 74.3 feet; S. 64deg. 10′ W. 114.9 feet and S. 69deg. 38′ W. 126.2 feet to a stake by a fence post; thence leaving the railroad rightof-way and running up the hill with a wire fence S. 8deg. 05′ W. 517.88 feet to a stake at a fence post and wire pole at the edge of the old Lashmeet Road; thence withg the North side of said Road N. 78deg. 05′ E. 396.8 feet to a fence post, the South West corner of said Kegley School Lot; thence with the same N. 5deg. 28′ W. 281.49 feet to the BEGINNING and containing 5.23 acres, plus or minus.”
AND BEING the same property conveyed unto Danny R. Dunn by deed of D. W. Barie, Trustee dated August 27, 2019, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Deed Book 1080, at Page 306. Said tract assessed on the land books of Rock District, Mercer County, West Virginia as 4. 15 acres, Kegley identified as Tax Map 39 Parcel 87 .1. And further being the same property conveyed unto Danny R. Dunn by deed of Steven E. Dunn dated February 24, 2017, of record in Deed Book 1048, at Page 252 being identified as Tax Map 39 Parcel 87.8, 0.41 acres Kegley.
The terms of the sale shall be cash in hand on the day of sale (or such other arrangement as may be satisfactory to Substitute Trustees and holder of the Note) and said property is being sold in “as is” condition. Said sale is subject to all taxes now due or to become due on said property, all liens, including but not limited to sewer liens and restrictions, easements or other matters of record in said Clerk’s Office affecting the title to said property. The purchaser is to pay the excise tax on the privilege of transferring said real estate.
In the event there are federal tax liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale, or the period allowable for redemption under local law, whichever is longer.
Notice is also given that any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
