NOTICE OF SUBSTITUTE TRUSTEE’S SALE
Notice is hereby given that by virtue of that certain Deed of Trust dated November 30, 2007, executed by David Earl Bauserman and Emma J. Bauserman, to David M. Moore, Trustee, said Deed of Trust being of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Trust Deed Book 621 at Page 318, the makers of the note and obligation secured thereby having failed to pay the same as provided for under the terms of said note and Deed of Trust, and default not cured within the terms of said note and Deed of Trust, the holder of the note having declared the whole thereof to be due and payable and having requested the undersigned, in writing, to make sale of the real estate described in said Deed of Trust, I will sell at public auction to the highest bidder on June 9, 2015, at 10:00 AM of that day at the front door of the courthouse of Greenbrier County, 200 North Court Street, Lewisburg, West Virginia, the following described real estate, to wit:
All those certain lots, tracts or parcels of land together with the buildings and improvements thereon, easements, rights of way, and the appurtenances thereunto belonging, situate in Ronceverte Municipality, Greenbrier County, West Virginia, and more particularly described as Lots 11, 13 and 15, on the north side of Ronceverte Avenue, east of Walnut Street, and Lots Nos. 12, 14 and 16, on the south side of North Avenue, east of Walnut Street as set forth and delineated upon a map designated as The Ronceverte Mining & Manufacturing Co., Map of Ronceverte, West Virginia, and also as “Baillies” Map of Ronceverte of record in the office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Map Book No. 1, at Page 1.
This property is being auctioned by Jeffry A. Pritt, Pritt Law Firm, PLLC, pursuant to his appointment as Substitute Trustee by that certain Substitution of Trustee, dated the 13th of April 2015, of record in the aforesaid clerk’s office in Trust Deed Book 745, at Page 725.
This property is being sold subject to the conditions, covenants, restric- tions, leases and other servitudes of record, if any, pertaining to said real estate, subject to all matters disclosed by an examination and inspection of the property, subject to any and all unpaid taxes as recorded against said property, and subject to any further matters at said sale.
The trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of sale described above or any adjournment thereof. The trustee reserves the right to reject any and all bids.
The subject property will be sold in “as is” condition. The trustee shall be under no duty to cause an existing tenant or person occupying the subject property to vacate said property. The trustee will deliver a Trustee’s Deed to the purchaser without any covenant or warranty (express or implied) in the form prescribed by WV Code ยง 38-1-6. The trustee makes no representation or warranties regarding the title of the real estate to be conveyed. If the trustee is unable to convey insurable or marketable title to purchaser for any reason, purchaser’s sole remedy is a return of the required deposit.
TERMS OF SALE: $5,000.00 cash in hand on the day of sale in the form of a certified check or cashier’s check made payable to Pritt Law Firm, PLLC, with the balance of the purchase price to be paid in cash at closing within 30 days of the date of the sale. Purchaser shall be responsible for any unpaid property taxes. Further, purchaser shall pay for transfer stamps and ,recording fees. Additional terms of sale may be announced prior to sale.
