NOTICE OF SUBSTITUTE TRUSTEE’S SALE

NOTICE OF SUBSTITUTE TRUSTEE’S SALE The undersigned Substitute Trustee, by virtue of the authority vested him by that certain Substitution of Trustee dated May 31, 2015, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Trust Deed Book 952, at Page 186, executed by James R. Chappel and Joyce G. Chappel, the secured parties of the Negotiable Promissory Note secured by that certain Deed of Trust dated the 15th day of June, 2012, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Trust Deed Book 896, at Page 184, wherein Gary Lee Chappel did convey unto the Trustee certain real property described in said Deed of Trust, and default having been made in the payment of the Negotiable Promissory Note secured thereby, a Notice of Right to Cure Default having been duly mailed to the said Gary Lee Chappel as required by law, and the undersigned Substitute Trustee having been instructed by the secured parties to foreclose thereunder, shall offer for sale at public auction at the front door of the Fayette County Courthouse in Fayetteville, West Virginia, on the 6th day of July, 2015 at 10:00 a.m., the following real estate, together with any improvements thereon, appurtenances thereunto belonging and rights incidental thereto, is situate in Valley District, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit: BEGINNING at an iron pin 50 feet W from the Chappel and Litton Lot which adjoins the Sutphin lot; thence N 35-1 E 115 feet to an iron pin 14 feet south of the edge of the hard surfaced road; thence with the line parallel to and 14 feet distant from the South edge of the hard surfaced road N 55-6 W 50 feet to a stake; thence leaving the road S 35-1 W 115 feet to a stake; thence S 55-6 E 50 feet to the beginning, containing 0.132 acre. And being the same real estate which was conveyed unto Gary Lee Chappel, by Deed of James K. Chappel and Joyce G. Chappel, dated the 15th day of June, 2012, and of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 682, at Page 709. The sale of the foregoing real property will be made subject to all exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record, if any, pertaining to said real estate, subject to all matters disclosed by an examination and inspection of the property, subject to any and all unpaid taxes as recorded against said property, and to any further matters announced at said sale. The property is sold subject to an accurate survey at purchaser’s expense and any unpaid real estate taxes assessed upon the foregoing described property. The sale of the foregoing real property will also be made expressly subject to any and other deeds of trusts, judgments, liens, and all other encumbrances of any nature whatsoever, if any, having priority over the deed of trust referred to herein. The Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of sale described above or any adjournment. The Trustee reserves the right to reject any and all bids. The subject property will be sold in “AS IS” condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. The Trustee will deliver a Trustee’s Deed to the purchase without any covenant or warranty (express or implied) in the form prescribed by West Virginia Code c38-1-6. The Trustee makes no representations and warranties about the title of the real estate to be conveyed. If the Trustee is unable to convey insurable or marketable title to purchaser for any reason, purchaser’s sole remedy is return of deposit.
