NOTICE OF SUCCESSOR TRUSTEE'S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, Eric M. Johnson and L. Elizabeth King, by that certain Deed of Trust made by Amanda Cox, dated April 10, 2013 and recorded April 18, 2013 in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 3951 at page 206, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated August 19, 2025 and recorded September 12, 2025, in the aforesaid Clerk's office in Trust Deed Book 4765, at page 898, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, on Wednesday, November 5, 2025 at 11:00 a.m. all that certain lot, piece or parcel of real property, together with improvements thereon, situate in Charleston, Charleston East District, Kanawha County, West Virginia, being more particularly bounded and described as follows: All that certain parcel of land situate on the north side of Virginia Street, between Elizabeth Street and Ruffner Avenue, in the City of Charleston, Kanawha County, West Virginia, fronting 57.5 feet on Virginia Street and extending back therefrom between parallel lines 70 feet, and having thereon a brick residence commonly known as 1552 Virginia Street, and being more particularly described as follows: BEGINNING at a point in the said north line of Virginia Street at the point of intersection of said line with the lower or westerly side line of Quarrier Walk, and running thence with said line of said Quarrier Walk, N. 39 06' E. 70 feet to a point; thence towards Ruffner Avenue and parallel with said Virginia Street, traversing the two car brick garage hereinafter mentioned, N. 61 54' W. 57.5 feet to a point in the original dividing line between Lots "T" and "U" of the Joel Ruffner Partition; thence with said last mentioned line, S. 39 06' W. 70 feet to a point in the northerly line of Virginia Street; thence with said line of said Virginia Street and towards Elizabeth Street, S. 61 54' E. 57.5 feet to the place of beginning. This deed is made and accepted subject to the party wall, two-car brick garage and joint driveway, exception, reservation, agreements, obligations and easements set forth in the aforementioned deed dated December 2, 1948, from Eulalie Skillman and Roy J. Skillman, her husband, to Margaret S. Hope dated December 2, 1948, of record in the aforesaid Clerk's Office in Deed Book 855, at page 445. Being the same property conveyed to Amanda S. Cox from Elizabeth Holcomb, Executrix under the Last Will and Testament of Martha Alice Paris, by deed dated June 1, 2004 and of record in the aforesaid mentioned Clerk's Office in Deed Book 2607 at Page 338. At the time of execution of the deed of trust, the grantor represented that the address of the property was 1552 Virginia St. E, Charleston, WV 25311. TERMS OF SALE: The Premises will be sold "AS IS, WHERE IS," in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's office or visible upon the ground. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and United Bank, Inc. shall not be responsible for the removal of any person or personal property from the Premises. The property will be sold to the highest bidder, who shall be obligated to pay an initial deposit to the Trustees at the time of sale in the minimum amount of 10% of the bid amount, and the remaining balance shall be paid to the Trustees on or within 20 days of the date of the auction. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
