NOTICE OF SUCCESSOR TRUSTEE’S SALE
Notice is hereby given that by virtue of the following deeds of trust:
1. Deed of Trust dated April 24, 2015 made by Rhonda M. Guy, D.O. aka Dr. Rhonda M. Guy, to Alan H. Larrick, Trustee, for the benefit of Community Trust Bank, Inc., which deed of trust is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book No. 5058, at Page 5167, Christopher J. Plybon having been named as successor trustee by instrument of record in the aforesaid Clerk’s Office on Microfilm Roll 5070, at Page 6473; and
2. Deed of Trust dated April 24, 2015 made by Rhonda M. Guy, D.O. aka Dr. Rhonda M. Guy, to Alan H. Larrick, Trustee, for the benefit of Community Trust Bank, Inc., which deed of trust is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book No. 5058, at Page 5171, Christopher J. Plybon having been named as successor trustee by instrument of record in the aforesaid Clerk’s Office on Microfilm Roll 5070, at Page 6472.
Default having been made in the payment of the obligations secured by such deeds of trust, the undersigned, Christopher J. Plybon, Successor Trustee, having been required to do so by Community Trust Bank, Inc., the beneficiary of such deeds of trust and holder of the obligations secured thereby, and having full and absolute power and authority in the premises, will on the 12th day of August, 2020, at 11:00 a.m. Eastern Time, offer for sale and sell at public auction, for cash to the highest bidder, at the main front door of the Courthouse of Raleigh County, at 215 Main Street, Beckley, West Virginia, the following described property:
The surface of all that certain tract of land, together with all improvements and appurtenances thereon, situate on the Beckley-Prince State Highway known as State Route 41, U. S. Route 19, in Town District, Raleigh County, West Virginia, and more particularly described as follows:
BEGINNING at the Northeast corner of said lot at a steel rail on the Western side of the right-of-way of U.S. Route 19 aforesaid, and a common corner of the E.A. Fellers property; thence North 89deg. 33′ W. 288.88 feet to a steel rail on the Southern line of the said E.A. Fellers property; thence South 0deg. 59′ E. 79 feet to another steel rail planted in the line of a parcel of land formerly owned by R. L. Maxwell; thence South 82deg. 25′ E. 293.06 feet and with the line of the said Maxwell tract to the Western side of the right-of-way of said U.S. Route 19 at a steel rail; thence with the Western right-of-way line of said U.S. Route 19, N. 1deg. 29′ W. 115 feet to the point of beginning, containing approximately 29,779 square feet.
A map or plat of which said tract is attached to and made a part of a deed recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book No. 372, at page 448, and reference is made to said map or plat recorded in Deed Book No. 372, at Page 448A, for a more adequate and complete description of the land conveyed by this deed, which map is identified as “PLOT PLAN OF LOT ON U.S. HIGHWAY NO, 19 TOWN DISTRICT, RALEIGH COUNTY, WEST VIRGINIA owned by F. H. CLEMONS and EULA CLEMONS Scale 1″=40` P. H. Wilson, C.E. Jun, 24, 1953”.
There is further GRANTED and CONVEYED an Easement, which Easement is recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book No. 604, at Page 829, to which reference is made for a more particular description of said Easement.
And being the same property acquired by Rhonda M. Guy, D.O., by Deed dated June 9, 2006 from Mountain State University Prospero B. Gogo Clinic, Inc., a non-profit corporation, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5022, at Page 4999.

TERMS OF SALE:
1. Cash in hand paid on the day of sale.
2. The sale is made “where is, as is” with no warranty whatsoever.
3. The Successor Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
4. Subject to any and all assessments and taxes against said property, and all matters of record in the aforesaid Clerk’s Office senior in priority to the deed of trust under which this sale is being made, including without limitation all prior liens and encumbrances of any nature whatsoever, including, without limitation, the liens for ad valorem taxes assessed against the property.
5. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 22 of Chapter 11 of the West Virginia Code.
6. If the sale is set aside, the purchaser at such sale may be entitled to only a return of the amount paid less any applicable fees and costs and shall have no further recourse against the Trustee, the Beneficiary, or any other person or entity.
7. The Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of sale described above or any adjournment thereof.
