NOTICE OF SUCCESSOR TRUSTEES’ SALE

NOTICE OF SUCCESSOR TRUSTEES’ SALE is hereby given pursuant to and by virtue of the authority vested in the Successor Trustees by that Deed of Trust, executed by borrowers, Robert E. K. Levick and Sharon K. Levick, dated March 21, 2007, and recorded on March 21, 2007 in the office of the Clerk of the County Commission of Hampshire County, West Virginia (the “Clerk’s Office”), in Book 446, at Page 548. Matthew L. Ward and Paige K. Vagnetti (“Successor Trustees”) were appointed as Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated March 31, 2025, and recorded in the Clerk’s Office on April 10, 2025, in Book 725, at Page 201. The borrower(s) have defaulted under the Note and Deed of Trust and the Successor Trustees have been instructed, by Farm Credit of the Virginias, ACA, to foreclose under the Deed of Trust. Accordingly, the Successor Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Hampshire County, in Romney, West Virginia, on:

WEDNESDAY, JUNE 4, 2025 AT 11:30 A.M.

The property is described as that certain parcel of land, together with all improvements thereon and the appurtenances thereto, and being more particularly described as follows:

All that certain tract or parcel of real estate together with any improvements thereon, situate in Springfield District, Hampshire County, West Virginia containing 77 acres, more or less, and which real estate is more particularly bounded and described as follows:

Beginning at a stone in the third line of the entire survey near a gate, thence N. 53 30’ W 107.5 poles crossing the entire tract to a stonepile in the 6th line of the entire survey; thence with it N. 49 30’ E 132.5 poles to a pile of stones, and original corner and a corner of J.W. Thompson’s Land (now H.W. Campbell) thence with the line as agreed upon by J.W. Thompson and P.W. Barnes as the line by which their lands are separated S. 40 15’ E 99.4 poles to a stone on the east side of the road; thence S. 46 W 64 poles to a stone; thence S. 48 15’ E 44.8 poles to the beginning, containing 77 acres, be the same more or less, and is conveyed by the boundary and not by the acre.

Being the same real estate conveyed unto Robert E. K. Levick and Sharon K. Levick, husband and wife, by Deed from Hetty E. Thompson, single, dated 5th day of January, 1994 and of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia in Deed Book 349, at Page 441.

TERMS OF SALE:

1. The property will be conveyed in an “AS IS, WHERE IS” physical condition by Deed containing no warranty, express or implied;
2. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever;
3. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 22 of Chapter 11 of the West Virginia Code;
4. The Beneficiary and/or Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale;
5. The Successor Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of sale described above or any adjournment thereof;
6. The Successor Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY;
7. The total purchase price is payable to the Successor Trustee by cashier’s check, cash or the equivalent within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale by cashier’s check or other certified funds.
8. If the sale is set aside, the purchaser at such sale may be entitled to only a return of the amount paid less any applicable fees and costs and shall have no further recourse against the Successor Trustee, the Beneficiary or any other person or entity.
9. Employees, directors and officers of Farm Credit of the Virginias, ACA, and their immediate family and companies in which they have an interest are not eligible under federal regulations to purchase this property at foreclosure.
