NOTICE OF SUCCESSOR TRUSTEE’S SALE
Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, James W. Lane, Jr. and Bradford P. Bury, by that certain Credit Line Deed of Trust made by Joseph W. Boswell III and Tamra F. Boswell, dated April 11, 2008, and recorded April 14, 2008, in the office of the Clerk of the County Commission of Greenbrier County, West Virginia in Trust Deed Book 629 at page 349, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated July 10, 2015, and recorded July 31, 2015, in the aforesaid Clerk’s office in Trust Deed Book 750, at page 262, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Greenbrier County, West Virginia, 200 North Court Street, Lewisburg, West Virginia, deed on Tuesday, November 17, 2015, at 10:30 AM, all that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, described as follows:
All that certain lot, tract or parcel of land, together with the buildings thereon, and the easements, rights of way and appurtenances thereunto belonging, situate in Fort Spring District, Greenbrier County, West Virginia, more particularly bounded and described as follows:
BEGINNING at a stake on the south line of U.S. Route No. 219, Fairlea, West Virginia, said stake being situate 130 feet southwest of the corner of the Wheeler Weikle lot in the Mac-Bet Addition; thence S 57-56 E 200.00 feet leaving the above named highway and on the O’Brien property to a stake; thence S 32-04 W 200.00 feet to a stake at the corner of the C. Taylor lot; thence N 57-56 W 200.00 feet with the line of the Taylor lot to a stake on the south line U.S. Route No. 219; thence N 32-04 E 200.00 feet with the south line of U.S. Route No. 219 to the point of BEGINNING, containing in all 40,000 square feet or 0.910 acre, more or less.
And being the same real property conveyed unto Joseph W. Boswell, III and Tamra F. Boswell, husband and wife, by deed dated September 21, 2006, from C.P. Taylor and Phyllis H. Taylor, husband and wife, and of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia in Deed Book 509 at Page 16.
At the time of execution of the deed of trust, the grantor represented that the address of the property was RR 2 Box 67, Ronceverte, WV 24970-0000.
TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The Premises will be conveyed by deed with no covenants of warranty of title. The Premises shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The Premises shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The Premises will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and Branch Banking and Trust Company shall not be responsible for the removal of any person or personal property from the Premises. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the Premises at such sale.
