NOTICE OF
SUCCESSOR TRUSTEE’S
SALE OF REAL PROPERTY
Notice is hereby given that, by virtue of the authority vested in the undersigned Steven M. Condaras, as Successor Trustee, by Deed of Trust made and executed by Danette A. Cook and Everett J. Cook, jointly as husband and wife, to Robert L. Milam Jr. and Carl W. Roop, as Trustees, dated March 17, 2014, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5055, at page 4995 (the “Deed of Trust”); and the said Steven M. Condaras, acting as Successor Trustee under and by virtue of a certain Appointment of Successor Trustee, dated April 27, 2018, and recorded in the aforesaid Clerk’s office in Trust Deed Book 5067, page 5354; and default having been made in the payment of the notes secured by the Deed of Trust, the owner and holder of said note, having elected to treat the whole principal debt secured by the Deed of Trust as immediately due and payable and having requested in writing the sale of the real estate conveyed by the Deed of Trust;
NOW, THEREFORE, the undersigned Successor Trustee, having been required so to do by said holder, Whitesville State Bank, will sell the real estate conveyed by the Deed of Trust at public auction to the highest bidder at the front door of the Courthouse of Raleigh County, West Virginia, in the City of Beckley, West Virginia, on September 7, 2018, at 11:00 a.m., local time, and which said real estate is more particularly described in the Deed of Trust as follows:
TRACT NO. 1
That certain tract or parcel of land known and shown as Lot No. 2 of Beechwood Subdivision No. 2, as shown on a map entitled BEECHWOOD-NO. 2 Map Showing Lots 1-6 Part of JAMES K. AND ELIZABETH CARPER D.B. 577, PG 745, D.B. 671, PG 392 SHADY SPRING DISTRICT, RALEIGH COUNTY, WEST VIRGINIA, TAX MAP 3, PARCEL 2, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map File 3, Page 409.
TRACT NO. 2
That certain tract or parcel of land known and shown as Lot No. 17, Phase 2, Beechwood Subdivision, located in Shady Spring District, Raleigh County, West Virginia, and shown on a subdivision, located in Shady Spring District, Raleigh County, West Virginia, and shown on a subdivision map recorded in the Office of the Clerk of the County Court of Raleigh County, West County, West Virginia in Map File 3, Page 152.

And being the same property conveyed to Danette A. Cook by Deed dated the 25th day of June, 2004 from Harry E. Wright, II and Deeanna J. Wright (also known as Deanna J. Wright), which said Deed is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Book 5013 at page 9253.
Subject to the Restrictive Covenants of Beechwood Subdivision No. 2 as listed in a Deed dated the 25th day of June, 2004 from Harry E. Wright, II and Deeanna J. Wright (also known as Deanna J. Wright) to Danette A. Cook, which said Deed is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Book 5013 at page 9253.

The above-described real estate will be conveyed by the undersigned Successor Trustee by deed without warranty of any kind, express or implied, and subject to all prior liens, and further subject to all unpaid real estate taxes or assessments, encumbrances and claims in favor of public service districts / municipal sanitary boards, if any, and also further subject to any covenants, restrictions, conditions, reservations, rights of way and easements of record in the aforesaid Clerk’s office and affecting the subject real estate, and without responsibility for or representations as to any items of personal property located thereon; and, any party claiming an interest in any item of personal property is responsible for the removal thereof prior to the date of sale.

TERMS OF SALE
1. Cash in hand on day of sale or cancellation of existing indebtedness in the discretion of the Successor Trustee;
2. Subject to any prior deeds of trust or security agreements of record;
3. Subject to any special assessments or any liens for taxes;
4. The above-described real estate will be sold by the undersigned Successor Trustees by auction to the highest bidder subject to the right of the undersigned Successor Trustees to reject all bids if, in her opinion, said bids are inadequate;
5. The owner of the indebtedness secured by the Deed of Trust shall have the right to bid; and
6. The sale shall be without representation or warranty of any kind, express or implied.

CONTINUANCE OR
ADJOURNMENT OF SALE
The undersigned Successor Trustees reserves the right to continue the sale or to adjourn the sale for a time or from time to time without further notice other than oral public announcement at the time and the place of sale as hereinabove set forth or at any continuance or adjournment thereof.
