In execution of a Deed of Trust in the original principal amount of FIFTY-ONE THOUSAND AND NO/00 DOLLARS ($51,000.00), dated October 15, 2014, recorded in the Office of the Clerk of the Circuit Court of TAZEWELL COUNTY, VIRGINIA, AS INSTRUMENT NUMBER 140003071, IN DEED BOOK 2014, AT PAGE 15378, default having occurred in the payment of the Note therein described and thereby secured, default having occurred in the performance of other obligations therein set forth, and at the request of the Holder of said Note, the undersigned Trustee will offer for sale at public auction at the entrance to the Courthouse of the Circuit Court of Tazewell, Virginia, 135 Court Street, Tazewell County, Virginia 24651, on August 19, 2020, at 10:00 a.m., the property described in said Deed of Trust located at the above address and briefly described as:

“All of that certain lot or parcel of land, with the improvements thereon and the appurtenances thereunto belonging, in “AS IS” condition, situate in the Jeffersonville Magisterial District, Tazewell County, Virginia, and being a part only of Lot 17, as the same appears on the certificate and enlarged map of lots shown on that certain map of O. E. Hopkins Estate, the certificate and plat of which are of record in the Clerk’s Office of the Circuit Court of Tazewell County, Virginia, in Deed Book 129, page 136, Plat Card 1079: also identified as Tazewell County Tax Map Identification Number 094A7 02 0017″.

Subject to the any and all covenants, conditions, restrictions, easements and all other matters of record taking priority over the Deed of Trust, if any, affecting the aforesaid property.

TERMS OF SALE: CASH: A deposit of $7,500.00 or 10% of the sales price, whichever is lower, cash or certified check will be required at the time of sale, but no more than $10,000.00 in cash will be accepted, with settlement to occur within fifteen (15) days from the date of sale. Sale is subject to post sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to the sale which affects the validity of sale, as well as to post-sale confirmation of the status of the loan with the Noteholder including, but not limited to, determination of whether the borrower entered into any repayment agreement, reinstated or paid off the loan prior to the sale, and paid all accrued Town and County real estate taxes due up until the time of sale. In such event, the sale shall be null and void, and the Purchaser=s sole remedy, in law or equity, shall be the return of his deposit without interest. Additional terms may be announced at the time of the sale. Pursuant to the Federal Fair Debt Collection Practices Act, you are advised that the Trustee is a debt collector attempting to collect the indebtedness referred to herein and any information obtained will be used for that purpose.
