NOTICE OF TRUSTEE SALE

NOTICE OF TRUSTEE SALE Notice is hereby given that by virtue of that certain Deed of Trust dated December 7, 2007, executed by Brandon M. Workman and Carmen D. Workman, married, unto J. Michael Anderson, Substitute Trustee, of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Trust Deed Book 812 at Page 108, the makers of the Note and obligation secured thereby having failed to pay the same as provided for under the terms of said Note and Deed of Trust, and default not cured within the terms of said note and Deed of Trust, the holder of the Note having declared the whole thereof to be due and payable and having requested the undersigned, in writing, to make sale of the real estate described in said Deed of Trust, I will sell at public auction to the highest bidder on September 11, 2015, at 10:00 a.m. of that day at the front door of the Courthouse of Fayette County, Fayetteville, West Virginia, the following described real estate, to-wit: TRACT ONE: BEGINNING at a stake on the northwest corner of Lot No. 11 of the Heaster Addition and being a common corner to the property herein conveyed; thence with the common line of said Lot No. 11 and Lot No. 12 of the Heaster Addition S 58 E 51 feet to a stake in the common line of Lots Nos. 11 and 12 of the Heaster Addition; thence leaving said line and running through Lot No. 12 of the Heaster Addition N 32-00 E approximately 145.0 feet to a point in the northern boundary line of said Lot No. 12 of the Heaster Addition; thence N 49-52 W 51 feet to a stake; thence running with the northwestern boundary line of said Lot No. 12 of the Heaster Addition S 32-00 W 150 feet to the point of BEGINNING, and containing 7,293 square feet, more or less, and being a portion of Lot No. 12 of the Heaster Addition. TRACT TWO: BEGINNING at a stake corner to Lot No. 10 and with the road S 58 E. 90 Feet to a stake, corner to street No. 2 and with said Street N. 57 15′ E 166.5 to a stake corner to Lot No. 12, N 58 W 161 feet to a stake corner to Lot No. 10, S 32 W 150 feet to the BEGINNING, containing 18.825 square feet and being Lot No. 11. TRACT THREE: BEGINNING at a stake at Street No. 3, a corner to Lot No. 24, N 45 15′ E 526 feet to a stake, S 49 15, E 430 feet to a stake at Street No. 2, with said street, S 57 15′ W 545 feet, to a stake at street No. 3, and with said street N 49 52′ W 313 feet to the BEGINNING containing 4.5 acres and being Lot No. 25. THERE IS HEREBY EXCEPTED AND RESERVED the following outsale from Robert Hanshew and Bessie Hanshew, his wife, to Oral J. Moore and Hazel Moore, his wife, by deed dated April 2, 1970, of record in Deed Book 296, at page 573, which is more particularly described as follows: BEGINNING at an iron pin in line of Lots Nos. 24 and 25; thence running with said line N 45-15 E 446 feet to a corner to same, and Lot No. 26; thence running with Lot No. 26, S 49-15 E 430 feet to a stake at Street No. 2; thence with said street S 57-15 W 545 feet to a stake at Street No. 3; thence with Street No. 3 N 49-52 W 189.3 feet to an iron pin in said Street line; thence leavings said Street N 45-15 E 80 feet to an iron pin; thence N 49-52 W 123.7 feet to the BEGINNING, containing 4.27 acres, more or less. AND BEING the same property conveyed unto Robert Hanshew and Bessie Hanshew, with rights of survivorship, by two separate deeds: First, from C.A. Ford, by deed dated September 10, 1963, of record in the Office of the Clerk fo the County Commission of Fayette County, West Virginia in Deed Book 251 at page 305. Second, from E.T. Vandall and Macel E. Vandall, his wife, by deed dated October 18, 1972, of record in the aforesaid Clerk’s Office in Deed Book 307, at page 638. The said Robert Hanshew died April 8, 2000 and by virtue of the survivorship clause, title to the property became vested in the name of Bessie Hanshew. Bessie Hanshew died testate on May 2, 2003, and by her Will dated August 2, 1996, probated July 22, 2003, of record in the aforesaid Clerk’s Office in Will Book 65, at page 631, she left the above described property unto Judy Hanshew Wills, known now as Judy A. Whalen. TERMS OF SALE: Cash in hand paid on day of sale subject to all unpaid property taxes, restrictive covenants, reservations, and easements. Given under my hand this 12th day of August, 2015. J.
