NOTICE OF TRUSTEE SALE

NOTICE OF TRUSTEE SALE Notice is hereby given that by virtue of that certain Deed of Trust dated February 16, 2001, executed by James R. Sizemore and Debra L. Sizemore, married, unto J. Michael Anderson, Substitute Trustee, of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Trust Deed Book 611 at Page 449, the makers of the Note and obligation secured thereby having failed to pay the same as provided for under the terms of said Note and Deed of Trust, and default not cured within the terms of said note and Deed of Trust, the holder of the Note having declared the whole thereof to be due and payable and having requested the undersigned, in writing, to make sale of the real estate described in said Deed of Trust, I will sell at public auction to the highest bidder on March 3, 2016, at 10:00 a.m. of that day at the front door of the Courthouse of Fayette County, Fayetteville, West Virginia, the following described real estate, to-wit: The following described tract or parcel of real estate, together with any improvements thereon, rights incidental thereto and any appurtenances thereunto belonging, situate in Adena Village, Valley District, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit: One-half of Lot 96, Section 3, that lies adjacent to Lot 97, Section 3, and all of Lot 97, Section 3, Adena Village, as shown on a map entitled, “Adena Village, Mount Carbon, West Virginia”, which is recorded in the Fayette County Clerk’s Office in Fayetteville, West Virginia, in Map Book 18 at Page 69 and 70. And being the same real estate which was conveyed unto James R. Sizemore and Debra L. Sizemore, husband and wife, by Deed of Vanbee, Inc., a West Virginia corporation, dated the 30th day of June, 1993, and of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 504 at Page 568. This Deed of Trust is made and accepted subject to all validly continuing reservations, restrictions, covenants, conditions, rights-of-way and easements made or contained in all prior deeds in the chain of title to the land herein conveyed, and is especially made subject to those certain restrictions and easements set out in the above mentioned Deed of record in the aforesaid Clerk’s Office in Deed Book 504 at Page 568, and further subject to the exceptions, reservations, restrictions, conditions, rights-of-way, licenses and easements set out in Deeds of record in said Clerk’s Office in Deed Book 340 at Page 314, and in deed Book 345 at Page 662.
