Notice of trustee sale

NOTICE OF TRUSTEE’S SALE
Take notice that on the 13th day of December, 2016, at 10:00 a.m., at the front entrance of the Marion County Courthouse, Fairmont, West Virginia, the undersigned Trustee will sell at public auction to the highest bidder the real estate hereinafter described pursuant to that certain deed of trust dated December 10, 2012, executed by Steven D. Berkey, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Trust Deed Book No. 1045, at page 83, default having been made therein, all of the following described lots or parcels of real estate situate in the City of Fairmont, Fairmont district, Marion County, West Virginia, described as follows:
FIRST PARCEL: A lot or parcel situate in the J.F. Watson Addition, a map or plat of which is of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 151, at page 14, described as follows:
PART OF LOT NUMBER NINE (9) IN BLOCK NUMBER THREE (3) IN AID ADDITION, fronting 50 feet on Apple Alley, and extending back with a uniform width of 50 feet a distance of 80 feet toward View Street, and being the rear portion of Lot No. 9 in Block No. 3 of said addition.
SECOND PARCEL: A parcel of real estate situate in the J. Fay Watson No. 1 Addition, a map or plat of which is of record in said Clerk’s office in Deed Book No. 74, at page 96, described as follows:
A PORTION (2/3) OF LOT NUMBER TEN (10) IN BLOCK NUMBER FOUR (4) OF SAID ADDITION, fronting 50 feet on Apple Court (formerly Apple Valley) and extending back between parallel lines 80 feet to Kullman. A map or plat of said parcel is of record in said Clerk’s office in Deed Book No. 722, at page 541.
The above real estate was conveyed to Steven D. Berkey by Frederick Todd Wise, by deed dated December 6, 2012, of record in said Clerk’s office in Deed Book No. 1124, at page 83.
Conveyance of said real estate is subject to the exceptions, reservations, restrictions, rights of way, and conditions of record, affecting said real estate, and is subject to all unpaid property taxes assessed against said real estate.
The property will be conveyed in an “as is” physical condition, without warranty as to habitability or fitness.
The trustee reserves the right to continue the sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the trustee.
The total purchase price is payable to the trustee by cashier’s check, cash, or the equivalent within 20 days of the date of sale, with 10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} of the total purchase price payable to the trustee at sale by cashier’s check, cash, or the equivalent.
