NOTICE OF TRUSTEE SALE Notice is hereby given that by virtue of that certain Deed of Trust dated March 24, 2008, executed by Ronald A. Meredith and Leona M. Meredith, his wife, unto J. Michael Anderson, Substitute Trustee, of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Trust Deed Book 819 at Page 431, the makers of the Note and obligation secured thereby having failed to pay the same as provided for under the terms of said Note and Deed of Trust, and default not cured within the terms of said note and Deed of Trust, the holder of the Note having declared the whole thereof to be due and payable and having requested the undersigned, in writing, to make sale of the real estate described in said Deed of Trust, I will sell at public auction to the highest bidder on March 24, 2015 at 9:00 a.m. of that day at the front door of the Courthouse of Fayette County, Fayetteville, West Virginia, the following described real estate, to-wit: The following described tract or parcel of surface land, together with the improvements and appurtenances thereunto belonging and the rights incidental thereto, situate in Adena Village, Valley District, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit: LOT NO. G, Section 4, as shown and designated on that certain map entitled “Re-subdivision of Lots 44-51, Adena village, Section Two, Valley District, Fayette County, West Virginia,” as shown on a map thereof recorded in the Fayette County Commission Clerk’s Office in Map Book 18 at page 64. This deed is made and accepted subject to all validly continuing reservations, restrictions, covenants, conditions, rights of way and easements made or contained in all prior deeds in the chain of title. Subject to the following: Adena Village Restrictions: 1. The property hereby conveyed is for residential purposes only, and no more than one house per lot shall be constructed thereon, except that there may also be constructed thereon an attached or detached garage in relation thereto, as provided herein. The residence, including an attached garage, shall be of no less than Twenty Thousand Dollars ($20,000.00) in value when completed as based on costs levels of the date hereof, and shall consist of no less than one thousand (1,000) square feet for a one story dwelling nor less than seven hundred (700) square feet on the ground floor for a dwelling of more than one story, but in no event shall the livable floor space of any dwelling be less than one thousand (1,000) square feet. 2. This deed is hereby made subject to the zoning ordinance, Fayette County, West Virginia, in effect on the date hereof, as the same may affect the property hereby conveyed, a copy of which is of record in said Clerk’s Office, reference to which is here made for a more complete recital thereof. 3. No trailer, mobile home or like unit, tent or other temporary building, except a temporary construction work building, shall be erected or installed on any lot at any time as a residence, either temporarily or permanently. 4. Any blocked building shall be considered complete if left unfinished on the surface of blocks, and the same shall either be painted or finished in some other attractive manner. 5. No livestock, poultry or other animals, except household pets, shall be permitted to be kept on the property. 6. A two foot easement along the sides of any lot, except two or more lots which are combined into one residential parcel, and in such event a two foot easement along the outer sides of such lots, and a five foot easement across the rear of all of such lots for the purpose of installation of all utilities for the benefit of the lot hereby conveyed and all other lots within the subdivision of adjoining subdivisions. 7. A right of all property owners within the subdivisions and any future subdivisions adjoining thereto to use the streets and ways shown on the map of the property hereby conveyed. And being the same property conveyed unto Ronald A. Meredith and Leona M. Meredith, his wife, from Montgomery General Hospital, Inc., (formerly Laird Foundation, Inc.) by deed dated August 24, 1999, recorded in the aforesaid Clerk’s Office in Deed Book 564 at page 631.
