NOTICE OF TRUSTEE SALE
Notice is hereby given that by virtue of that certain Deed of Trust dated 28th day of April, 2004, executed by Thomas J. McKula, Jr. Trustee of the Thomas J. McKula Living Trust Dated May 5, 1998, unto J. Michael Anderson, Substitute Trustee, of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Trust Deed Book 531 at Page 183, the makers of the Note and obligation secured thereby having failed to pay the same as provided for under the terms of said Note and Deed of Trust, and default not cured within the terms of said note and Deed of Trust, the holder of the Note having declared the whole thereof to be due and payable and having requested the undersigned, in writing, to make sale of the real estate described in said Deed of Trust, I will sell at public auction to the highest bidder on January 9, 2020, at 9:00 a.m. of that day at the front door of the Courthouse of Greenbrier County, Lewisburg, West Virginia, the following described real estate, to-wit:
All that surface only of that certain lot, tract or parcel of land together with the improvements thereon, easements, rights of way, and the appurtenances thereunto belonging, situate in White Sulphur District, Greenbrier County, West Virginia, and more particularly designated and described as Lot/Unit 17 (seventeen) in Howard’s Creek Phase One Neighborhood (the “Lot/Unit”), of the planned community known as “The Greenbrier Sporting Club”, as shown upon a map or plat of subdivision dated August 27, 2002, prepared by Draper Aden Associates, entitled “Subdivision Plat, Howard Creek Phase One Neighborhood, The Greenbrier Sporting Club Development Company, LLC, White Sulphur District, Greenbrier County, West Virginia” a copy of which is filed in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, indexed in Record of Maps Book No. 4, in File Cabinets B-78 through B-79, inclusive (the “Subdivision Plat”), and also shown upon a map or plat of subdivision dated October 25, 2002, prepared by Draper Aden Associates, entitled “Plat of Correction Howard’s Creek Phase One Neighborhood, (Formerly Howard Creek Phase One Neighborhood), The Greenbrier Sporting Club Development Company, LLC, White Sulphur District, Greenbrier County, West Virginia, a copy of which is filed in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, indexed in Record of Maps Book No. 4, in File Cabinets B-85 and B-86, inclusive (the “Subdivision Plat”), together with a nonexclusive, perpetual right of way and easement over and across that parcel of land shown and described upon the Subdivision Plat as “Maple Grove Way”, “Old Stage Road” and “Courtship Circle” (collectively, the Neighborhood Streets”). The “Neighborhood Streets” shall be and remain private, and no dedication thereof to public use is intended hereby. There is also granted and conveyed an “Access Easement” consisting of a perpetual right of way and easement in common with CSX, its employees, agents, contractors, lessees, invitees, successors and assign, over and across the portion of Village Run” described in Deed Book 337 at Page 248 which runs from its intersection with U.S. Route 60 to its intersection with “Old Stage Road”. The Access Easement is for the purpose of providing access from the Neighborhood Streets to U.S. Route 60. The Access Easement shall be and remain private, and not dedication thereof to public use is intended hereby.
And being the same property conveyed unto The Thomas J. McKula, Jr. Living Trust, by deed dated April 28, 2004, from POM, LLC, a West Virginia limited liability company, recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 489 at Page 490.
TERMS OF SALE: Cash in hand paid on day of sale subject to all unpaid property taxes, restrictive covenants, reservations, and easements.
