NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated November 16, 2007, executed by Borrower(s), Jennifer C. Flora and Travis L. Timbrook, to Carl M. Cather, III, the Trustee of record in the office of the Clerk of the County Commission of Hampshire County, West Virginia, in Book 464, at Page 660.  At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 114 Dunmore Ridge Rd f/k/a 18 Dunmore Ridge- Route 50, Augusta, WV 26704. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated December 26, 2025, of record in the Clerk’s Office in Book 736, Page 759.  The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust.  Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Hampshire County, in Romney, West Virginia, on the following date:

March 18, 2026, at 9:06 a.m.

All those two certain tracts or parcels of real estate described as follows:

FIRST – All that certain tract or parcel of real estate containing 0.97 acres, more or less, together with the improvements thereon, all rights, rights of way, easements, waters, minerals oil and gas and appurtenances thereunto belonging, situate on the west side Dunmore Ridge Road, State Route 50/18, in Sherman District, Hampshire County, West Virginia, and being more particularly described as follows:

BEGINNING for the same at a pipe set on the west side of aforesaid road, said point being approximately 185 feet southerly from the intersection of said west side on aforesaid road with the northerly direction of the property of Richmond H. Gibson and Irene B. Gibson; thence across the property of Richmond H. Gibson and Irene B. Gibson, parallel to the northerly boundary thereof, N. 47 53 40 W. 281.40` to a pipe; thence N. 26 35 00 E. 155.00 feet to a pipe set on the south side of a 30-foot right of way; thence with said south side, parallel to said northern boundary and 30 feet distant therefrom S. 47 53 40 E. 261.40 feet to a pipe, to the point of curve of a small curve; thence with the arc of said curve 34.18 feet to a pipe, the point of tangent of said arc; and on the west side of Dunmore Ridge Road; thence with the west side of aforesaid road, S. 26 35 00 W. 135.00 feet to the BEGINNING, containing 0.97 acre, more or less.

SECOND – All that certain tract or parcel of land containing 1.055 acres, situate on the west side of Dunmore Ridge Road (State Route #50/18) in Sherman District of Hampshire County, West Virginia, and being more particularly described as follows:

BEGINNING for the same at a pipe set on the west side of said Dunmore Ridge Road, said point being the beginning point in a certain deed dated March 15, 1972, wherein the said Richard H. Gibson and Irene B. Gibson conveyed unto Harold D. Mowrey and Delores B. Mowery a certain treat or parcel of land containing 0.97 acres; thence, with the west side of aforesaid road south 26 35 00 West 132 feet to a pipe, thence across the property of Richard H. Gibson and Irene B. Gibson, N. 63 25 00 East 207.31 feet to a pipe, said pipe being situated at the end of the first line in the aforesaid deed of March 15, 1972, thence with said first line reversed, S. 47 53 40 E. 281.40 feet to the point and place of the BEGINNING, containing 1.055 acres, more or less, according to the plat of survey made by Allen G. Clem, Licensed Land Surveyor, a copy of which survey in of record in the aforesaid clerk`s Office in Deed Book 296 at Page 398, and the same is incorporated herein and made a part hereof as if it appeared textually verbatim herein.

And being the same real estate conveyed unto Travis L. Timbrook and Jennifer C. Flora by deed of Larry A. Largent and Kathy Largent, his wife, dated November 16, 2007, and recorded at Book 469, Page 747 in the Office of the Clerk of the County Commission of Hampshire County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
