VALUABLE REAL ESTATE
Pursuant to the authority vested in the undersigned by deed of trust dated the 29th day of January 2016, signed by Julie Cooper, to Robert Alan Milner, Trustee(s), which said deed of trust is of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Trust Deed Book 1138, at page 338, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 9:00 o’clock A.M. on the
16th day of JANUARY 2020
at the front doors of the Courthouse in Marion County in Fairmont, West Virginia the following described real estate:
1.88 acres – Beginning at a 1/2” iron pin found in a common point of Stone Ridge Properties, LLC, and Richard and Barbara Grigg; thence with three new division lines through Richard and Barbara Grigg, S 01 degrees 29’ 13” E 420.16 feet to a 5/8” iron pin set; thence N 79 degrees 45’ 56” W 251.01 feet to a 5/8” iron pin set; thence N 06 degrees 29’ 19” E 316.57 feet to a 5/8” iron pin found in line of Stone Ridge Properties LLC; thence with two lines of Stone Ridge Properties, LLC N 76 degrees 46’ 31” E. 21.34 feet to a 1/2” iron pin found; thence N 72 degrees 40’ 47” E 188.10 feet to the place of beginning, containing 1.88 acres more or less, as shown on the plat of record in Deed Book 1186 at page 843.
Together with the right to use in conjunction with Grantors, their heirs, successors and assigns that certain right of way for means of ingress, egress and regress to and from WV Sec Rt. 33, through the remainder of the other lands of Grantors, which access the right of way is described as follows: Beginning at a point on the western right of way limits of WV Sec. Rt. 33 and located N 07 degrees 00’ 25” E. 9.64 feet from the southeastern most corner of a 7.26 acre parcel owned by Grantor Griggs; thence with the centerline of the 16 foot joint or nonexclusive use right of way for six lines, N 69 degrees 36’ 05” W 89.04 feet to a point; thence N 59 degrees 54’ 43” W 56.31 feet to a point; thence N 51 degrees 01’ 49” W 94.20 feet to a point; thence N 45 degrees 25’ 09” W 67.55 feet to a point; thence N 36 degrees 59’ 59” W 94.80 feet to a point; thence N 26 degrees 14’ 49” W 38.71 feet to a point and thence N 11 degrees 43’ 16 W 26.13 feet to a point standing on the southern line of the 1.88 acre tract. Said right of way is depicted on the plat referenced hereto made for all pertinent purposes regarding said right of way.
It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.

TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third-party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.
Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder.
Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record.
