NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE
Pursuant to the authority vested in the undersigned by deed of trust dated the 1st day of May, 1998, signed by Brian S. Daniels and Shelley D. Daniels to Douglas C. McElwee, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 288, at page 485, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor/Servicer, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor/Servicer and present holder of the note, said Trustee will sell at public auction at 1:00 o’clock P.M. on the
22nd day of APRIL 2015
at the front doors of the Courthouse in Randolph County in Elkins, West Virginia the following described real estate:
A tract or parcel of real estate situate in Beverly District, Randolph County, West Virginia, southwest of West Virginia Secondary Route 37, being more particularly bounded and described as follows: Beginning at a point in the center of West Virginia Secondary Route 37; thence S 42 53 00 W 168.56’ leaving said WV Secondary Route 37, passing a found aluminum rod at 12.34’, crossing Stalnaker Run, and traveling to a found 3/4” iron pipe. Said iron pipe bears S 34 36 36 E 212.64’ from a found 1” iron pipe; thence S 44 26 49 W 50.74’ traveling to a found 1” iron rod, common corner to Lewis, DB 427/567; thence N 43 11 51 w 276.36’ traveling with a line or a portion of a line common to Lewis, DB 427/567, to a point in or near the southwestern bank of Stalnaker Run; thence N 45 03 07 W 14.27’ traveling with a line or a portion of a line common to Lewis, DB 427/567, to a point in or near the center of Stalnaker Run; thence N 61 53 34 E 286.77’ traveling through Lewis, DB 278/240, passing a set 5/8” rebar at 11.10’ and passing a set 5/8” rebar at 271.87’ to a point in the center of WV Secondary Route 37; thence S 23 49 30 E 54.71’ traveling with the center of said WV secondary Route 37, to a point; thence S 31 36 26 E 58.46’ traveling with the center of said WV Secondary Route 37, to a point; thence S 37 09 03 E 52.27’ traveling with the center of said WV Secondary Route 37, to a point; thence S 34 52 16 E 132.86’ to the beginning, containing 1.89 acres, more or less, as surveyed by Kenneth Kelly, PS #973 of Dailey, WV, in September, 1997. The above conveyances is made SUBJECT to any and all rights, restrictions, and reservations as contained in the prior chains of title. Included in the property is a manufactured home with the following description:
All the property located at LOUK RUN ROAD, in the City/Town/Village of BEVERLY, County of RANDOLPH, State of WV, in which the Borrower has an ownership, leasehold or other legal interest. This property is more particularly described on the schedule titled “Additional Property Description” which is attached hereto as Exhibit A, together with a security interest in that certain 1998, 52 x 28 WOODLAND PARK mobile home, serial number NCFLW69AB15891WP13.
It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.

TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.
Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder.
Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record.
