NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE Pursuant to the authority vested in the undersigned by deed of trust dated the 24th day of November, 2003, signed by Kathleen Fitzpatrick, an unmarried person, to Michael W. Raber, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Trust Deed Book 701, at page 263, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 2:00 o’clock, p.m. on the 24TH DAY OF FEBRUARY 2015 at the front doors of the Courthouse in Fayette County in Fayetteville, West Virginia the following described real estate: The following described tract or parcel of surface land, together with improvements thereon, appurtenances thereunto belonging and rights incidental thereto, situate on the Waters of Brackens Creek, New Have District (formerly Sewell Mountain District) Fayette County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at a concrete monument 10 to 15 inches below the original surface at the edge of a dirt road; thence running N 27 degrees 49′ W 228.78′ with a 36″ sugar maple tree; thence running N 18 degrees 34′ W 234.38′ to a shell bark hickory tree; thence continuing N 18 degrees 6′ E 289.62′ to a concrete monument in a rock mound; thence turning 66 degrees 0′ W 143.63′ to a concrete monument in a rock mound; thence running N 2 degrees 59′ E 594.94′ with an old rail fence or traces thereof to a concrete monument in a rock mound between a twin 23″ poplar tree with 3 hatch marks and 14″ pignut hickory tree with hatch marks; thence running N 62 degrees 18′ E 1286.77′ to a 31″ beech tree at the edge of the left fork of Scotts branch; thence running N 23 degrees 00′ E 657.73′ to a concrete monument more or less in the center of a 26″ poplar tree with 3 hatch marks and a 6″ walnut tree running, more or less, with an old rail fence or traces thereof, thence N 84 degrees 05′ W 1448.49′ to the point of beginning, and containing 27.789 acres, more or less. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust. The above described real estate is reported to have a mailing address of: RR 82 Box 125B, Rainelle, West Virginia 25962 TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees. Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
