NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated December 28, 2011, executed by Borrower(s), Stanley Jakubik Jr., to BB&T Collateral Service Corporation, the Trustee of record in the office of the Clerk of the County Commission of Clay County, West Virginia, in Book 128, at Page 389. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2937 Queen Rd, Clendenin, WV 25045. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated June 8, 2022, of record in the Clerk’s Office in Book 36, Page 310. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Clay County, in Clay, West Virginia, on the following date:
21st day of September, 2022 at 11:30 a.m.
All that certain tract or parcel of surface land, together with the improvements thereon and the appurtenances thereunto belonging, situate on the Waters of Porters Creek in Union District, Clay County, West Virginia, and bounded and described as follows: BEGINNING at an iron stake fifteen (15) west of a culvert under the state road, and running thence N. 1-1/2 E. 10 poles to an iron stake; thence N. 32 E. 18 poles to a gas well; thence N. 20 W. 26 poles to an iron stake in Phil Young’s line; thence N. 65 E. 11 poles running with Phil Young’s line to a rock with one X hickory and white oak pointers; thence S. 29 E. 57 poles running with O. L. Hart’s line to a rock at the road; thence running with the road 350 feet to the place of beginning, containing five (5) acres, more or less; and being the same property conveyed to Stanley Jakubik, Jr., from Sharon L. Jakubik, by deed dated January 28, 2008, and of record in the office of the Clerk of the County Commission of Clay County, West Virginia, in Deed Book 201, at page 982. The subject property is made subject to the following rights of ways: a) Of record in the said Clerk’s office in Deed Book 179, at page 112, there is a right of way deed dated September 3, 1998, from Stanley Jakubik, Jr. and Sharon L. Jakubik, to Columbia Natural Resources, Inc, for an easement agreement. b) Of record in the said Clerk’s office in Deed Book 203, at page 1168, there is a right of way deed dated March 29, 2005, from Stanley Jakubik, Jr., to Queen Shoals Public Service District, for an easement agreement. The subject property is made subject to any and all covenants, restrictions, and easements as the same may appear in instruments of record in the aforesaid Clerk’s office.
Being the same property conveyed to Stanley Jakubik Jr. by the Deed dated January 28, 2008 and recorded in Deed Book 201 at Page 982 in the Office of the Clerk of the County Commission of Clay County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty,
express or implied, subject to the Internal Revenue Service right of redemption, all property taxes,
prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants,
conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia
Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid
for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or
oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property
to vacate said property, and any personal property and/or belongings remaining at the property after
the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE
DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten
(10%) of the total purchase price payable to the Trustee at sale.
