NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated September 17, 2009, executed by Borrowers Arnold Mounts and Margaret A. Mounts, to Phillip Hereford, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5037, at Page 153. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 405 Church Street, Lester, WV 25865. Pill & Pill, PLLC was appointed as Substitute Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated June 11, 2015, of record in the Clerk’s Office in Book 5059, Page 3063. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date: September 10, 2015 at 2:15 p.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Trap Hill District, Raleigh County, West Virginia, and being more particularly described as follows: The following described tract or parcel of surface land, with any appurtenances thereunto belonging, lying and being on the old Glen White to Lester County Road, near the Town of Lester, in Trap Hill District, Raleigh County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at a stake, which is the southeast corner of a tract of land conveyed to Debra Jeffery from Robert M. Stafford, single, by deed dated the 5th day of November, 1987; thence with the eastern boundary line of the Debra Jeffery property 60 feet to a stake on the Giammerino line; thence with the Giammerino line in an eastern direction 100 feet to a stake; thence leaving the Giammerino line and through property owned by Robert M. Stafford, parallel to the first call and 100 feet therefrom, 50 feet to a stake; thence in a western direction approximately 105 feet back to the point of beginning. The tract of land hereby conveying being 60 feet on the West; 100 feet on the North; 50 feet on the East; and 105 feet on the South. And being the same property acquired by Arnold Mounts and Margaret Ann Mounts, husband and wife, by deed dated August 24, 2000, from Margaret Ann Mounts and Arnold Mounts, wife and husband, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Book 5002, at page 9883. There is further granted and conveyed unto the parties of the second part, their heirs and assigns, a right of ingress and egress to the property hereby conveyed from the old Glen White to Lester County Road, and also the right to use a parking lot, which has been established in the southwest corner of property described in the Deed recorded in the aforesaid Clerk’s Office in Deed Book No, 501, at page 404; and said right of ingress and egress is to be over the road which is now in existence. The said right of ingress and egress is to be used in common with other persons having the right so to do, and said right of ingress and egress is not to be obstructed by any substances whatsoever.
