NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE`S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustees, Richard A. Pill, David D. Pill, and Amanda E. Steiner, any of whom may act, by that certain Deed of Trust dated January 4, 2005, executed by Borrowers, Clarence Terrell, Jr. and Anita Terrell, to George Anthony Metz, Jr., the Trustee of record in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Book 731, at Page 577. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 168 Boomer Loop Road, Boomer, WV, 25031. Richard A. Pill, David D. Pill, and Amanda E. Steiner were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 28, 2014, of record in the Clerk`s Office in Book 942, at Page 41. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Fayette County, in Fayetteville, West Virginia, on the following date: February 12, 2015 at 1:48 p.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Valley District, Fayette County, West Virginia, and being more particularly described as follows: Tract No. 1 BEGINNING at an iron pin corner located on the dividing line running betweeen the John Buckholt and W.M. Shamblin property which said iron pin is also corner to Herbert Grant property; thence in a southerly direction 40 feet and along said dividing line between John Buckholt and W.M. Shamblin property to an iron pin corner; thence at right angles in a Westerly direction 40 feet to an iron pin; thence in a Northerly direction 40 feet to an iron pin located on the line of the property owner by Herbert Grant; thence in an Easterly direction 40 feet and along the line dividing W.M. Shamblin and that of Herbert Grant to the point of beginning, it being the intention of the said party of the first part to convey a lot of approximatley 40 feet by 40 feet lying adjacent to and South of the property recently conveyed to Herbert Grant and being a part of the same property that was heretofore conveyed to W.M. Shamblin by S.A. Mullins and Minnie L. Mullins, his wife, by deed dated the 28th day of July, 1924, and of record in the Office of the Clerk of the County Court of Fayette County, West Virginia, in Deed Book 58, at page 38, reference to which said deed is here made for the purpose of a fuller and more accurate description of the property hereby conveyed. The above property is conveyed subject to the exceptions and reservations of mineral rights contained in prior deeds. Right of way easement for the purpose of ingress and egress to the said property of a walkway or travel way and running along the Southern boundary of the lot hereby conveyed and in a Westerly direction to a walkway or travel way located upon W.M. Shamblin property. Tract No 2: BEGINNING at the corner of G.H. Bradley’s line and running with Grant’s line to Earl Browning’s corner, S. E. 17 feet, more or less; thence due S 40 feet to corner of Earl Browning’s line; thence N. W. 13 feet more or less to Bradley’s corner; thence due N to Bradley’s corner to the place of beginning. Being the same property conveyed to Clarence Terrell, Jr. and Anita Terrell by Deed dated August 28, 1998, and recorded in Deed Book 553, at Page 293 in the Office of the Clerk of the County Commission of Fayette County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code c 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee by certified or cashier’s check within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
