NOTICE OF TRUSTEE’S SALE NOTICE is hereby given that default having been made under the terms of a Deed of Trust dated December 8, 2011, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5045, at page 3924, executed by Jamie L. Murdock and Samantha L. Murdock to Alan R. Terry and Carl W. Roop, Trustees, securing Pioneer Community Bank, which was given to secure the payment of the note therein described, and demand having been made upon the undersigned so to do, the undersigned Trustee, Carl W. Roop will, on the 26th day of February, 2015, at the front door of the Raleigh County Courthouse, in the City of Beckley, West Virginia, at 9:00 a.m., sell the property hereinafter described, which property was conveyed in said deed of trust, and being more particularly described as follows: All that certain tract/lot or parcel of real estate, together with any building or improvements thereon, rights and rights of way incidental thereto, and appurtenances thereunto belonging, situate in Marsh Fork District, Raleigh County, West Virginia, and more particularly bounded and described as follows: BEGINNING at a 36″ poplar a corner to the Desi Jean Sarrett property, and the David Honaker property; thence with the Desi Sarrett lines 54 f 10 E. 154.08 feet to a 36″ oak; thence S. 69 f 10 E. 84.05 feet to a stake; thence S. 73 f 06 E. 41.28 feet to a stake at the edge of Saxon Posey Road; thence running with Saxon Posey Road S. 13 f 46 W. 79.00 feet to a stake; thence S. 22 f 45 W. 68.30 feet to a 10″ pine; thence leaving the Saxon Posey Road and running with the Roger D. Pettry line N. 56 f 58 W. 111.20 feet to a roof bolt; thence N. 59 f 53 W. 205.42, feet to a roof bolt on a 15 foot right-of-way thence N. 33 f 18 E. 149.83 feet to the point of beginning, containing 0.89 acres (also described as 0.98 acres). And being the same real estate conveyed unto Jamie L. Murdock and Samantha L. Murdock by Deed dated the 4th day of April, 2011 from Secretary of Housing and Urban Development, and or his successors, by Dalerie Williams of Harrington, Moran, Barksdale, Inc., as the duly appointed delegate of the U.S. Department of Housing and Urban Development which said Deed is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Book 5042 at Page 8951. Said property will be sold upon the following terms and conditions: 1. Cash in hand on day of sale. 2. The property will be conveyed in an “AS IS” condition by Deed containing Special Warranty of Title, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, validly enforceable prior liens, reservations, encumbrances, restrictions, right-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 3. The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4. The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, or remove any personal property and/or belongings remaining at the property. 6. The purchaser(s) at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property. 7.
