NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Richard A. Pill, David D. Pill, and Amanda E. Steiner, any of whom may act, by that certain Deed of Trust dated October 8, 2002, executed by Borrower, William K. McGraw to James B. Crawford, III, the Trustee of record in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Book 663, at Page 423. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1491 Saturday Rd, Victor, WV 25938. Richard A. Pill, David D. Pill, and Amanda E. Steiner were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 24, 2014, of record in the Clerk’s Office in Book 942, Page 38. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Fayette County, in Fayetteville, West Virginia, on the following date: January 14, 2016 at 10:30 a.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in New Haven District, Fayette County, West Virginia, and being more particularly described as follows: LOTS NOS. 34, 35 and 38 Beginning at a stake in the right of way line of the Saturday Road and running with said right of way North 51 West 200 feet to a stake, at the edge of a street and with the east side of said street North 73 West 245.86 feet to a stake on the edge of a street and with the street paralleling the Saturday Road North 17-00 West 200 feet to a stake, thence South 68-52 East 210 feet to the beginning, being Lots Nos. 34 and 35 of the subdivision No. 2 of the Taylor Farm near Victor, West Virginia. Beginning at a stake on a street paralleling the Saturday Road and running with the same South 17-00 West 107.24 feet to a stake on the corner of the street North 73-15 West 219.57 feet to a stake on the line of Lot No. 37 and with the same North 17 east 132.71 feet to a stake South 66-00 East 219 feet to the beginning and being Lot No. 38 of the above subdivision and containing 26,280 square, more or less. And being the same real estate which was conveyed unto Rufus J. Dempsey by the deed of Marion Taylor, Trustee, dated June 14, 1951, and recorded in the office of the County Commission of Fayette County, West Virginia, in Deed Book 166, and at page 298, reference to which is here made for a more complete description. And being the same property conveyed to Curtis Homes, a partnership, by deed of Gary L. Cole and Patricia K. Cole, his wife, dated the 7th day of October, 1981, and recorded in the office of the Clerk of the Fayette County Commission in Deed Book 407, at page 155. And being the same property conveyed to Curtis Financial Corporation, a Minnesota corporation, by Quit Claim Deed dated April 11, 1984, from Curtis Homes, A Partnership, and filed for record on May 17, 1984, in the office of the Clerk of the County Commission, Fayette County, West Virginia, in Book 426, Page 229. Being the same property conveyed to William K. McGraw by the Deed dated October 8, 2002 and recorded in Deed Book 663 at Page 423 in the Office of the Clerk of the County Commission of Fayette County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code c 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
