NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Trustee, Richard A. Pill, by that certain Deed of Trust dated November 7, 2005, executed by Borrowers, Ernest M. Gray and Phyllis J. Gray, to Richard A. Pill, the Trustee of record in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Book 754, at Page 102. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 746 Summerlee Avenue, Oak Hill, WV 25901. The borrowers defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Fayette County, in Fayetteville, West Virginia, on the following date: March 15, 2016 at 1:30 p.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Oak Hill District, Fayette County, West Virginia, and being more particularly described as follows: The following described parcels of real estate, situate in the City of Oak Hill, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit: PARCEL ONE: Lot No. 1, as shown and designated on a map of Halstead Court No. Two, of record in the Fayette County Clerk’s Office in Map Book 13, Page 12, and which said lot faces 6o feet on Summerlee Avenue and extends back 140 feet. PARCEL TWO: A triangular parcel of real estate situate on the north of said Lot No. 1, and bounded on the south line of property conveyed herein by Gregory. Said parcel lies adjacent to the north line of Lot 1, referred to above, is approximately 9 feet 8 inches wide on the west side and decreases to two feet on the east side and is 60 feet in length. And being the same property acquired by Ernest M. Gray, by Deed dated the 28th day of October, 2005 from Harry Keith Price, which said Deed is to be recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, prior to or simultaneously herewith. And being the same property acquired by Harry Keith Price, by deed dated the 27th day of June 2005, from Charles William Price, which said Deed is recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book No. 613 at Page 746. And being the same parcels of real estate which were conveyed unto Harry Keith Price and Charles William Price, subject to the life estate of Goldie Mae Price, by deed of Samuel Curtis Price, single, and Daniel Ray Price and Martha Price, his wife, dated June 16, 1998 and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book No. 551 at Page 36. Being the same property conveyed to Ernest M. Gray and Phyllis J. Gray by the Deed dated October 28, 2005 and recorded in Deed Book 616, at Page 631 in the Office of the Clerk of the County Commission of Fayette County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code c 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
