NOTICE OF TRUSTEE’S SALE
In execution of the deed of trust, dated March 10, 2008, from David B. Cox and Annette L. Cox to Stephen M. Feola and Gary R. Mills, as trustees, of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Trust Deed Book 627, at page 110, the undersigned trustee will offer for sale at public auction on July 1, 2016, at 10:00 AM at the front door of the Greenbrier County Courthouse, 200 North Court Street, Lewisburg, West Virginia, all that certain lot, tract or parcel of land together with the buildings and improvements thereon, easements, rights of way, and the appurtenances thereunto belonging, situate in Fort Spring District, Greenbrier County, West Virginia, and being more particularly described as follows:
Beginning at an iron pin in a driveway a corner to Douglas Taylor, located approximately 597 feet northwest of the center line of Sunset Drive in Fairlea; thence following the driveway and the Taylor line N 45˚ 05′ W 214.20 feet to an iron pin in a wire fence on the line of Margaret Cary; thence leaving the Taylor line and with the Cary line N 37˚ 40′ E 74.40 feet to a fence post a corner to Elzie H. McCormick; thence with the McCormick N 37˚ 33′ E 191.00 feet to a fence post on the line of the Mack Wade property; thence with the Wade line S 53˚ 36′ E 78.40 feet to a fence post; thence leaving the Wade line S 31˚ 21′ W 272.50 feet to an iron pin; thence S 42˚ 14′ E 106.78 feet to anron pin; thence S 45˚ 10′ W 4.63 feet to the beginning, containing 0.60 acres, more or less.
And being the same real property conveyed unto David B. Cox, by deed dated December 7, 2005, from Joan L. Cox, of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia in Deed Book 502 at Page 797. The said Joan L. Cox reserved a life estate in the afore said property, but upon her death on January 6, 2006, property vested fully in David B. Cox.
Reference is hereby made to all prior instruments in the chain of title for all reservations, restrictions, limitations and easements and right of way affecting the property herein conveyed.
J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated June 2, 2016, of record in said Clerk’s Office in Trust Deed Book 763, at page 114.
This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements, and mechanic’s and materialmen’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.
TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by special warranty deed. The real estate and any improvements thereon will be sold in as is condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
