NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of the authority under that certain deed of trust executed by Jane A. Newton, to Nicholas W. Johnson and Marc J. Slotnick, Trustee(s) dated June 28, 1996, and recorded in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 95, at page 745, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee dated October 22, 2014, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on December 15, 2014 at 12:30 p.m., at the front door of the courthouse of Raleigh County, West Virginia, the real estate conveyed by said deed of trust and situate in Town District, Raleigh County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was: 518 Cleveland School Road, Beckley, West Virginia, and being more particularly bounded and described therein as follows: All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Crab Orchard, in the Town District of Raleigh County, and more particularly described as follows: BEGINNING at a rebar (called for) on the R/W of W. Va. Sec. Rte. 18. Being the common corner of the Basil & Brenda Campbell (MP.27-FR1383) and the Deborah L. & Danny F. Murdock (MP.33-FR242) parcels of land. Thence leaving the said road R/W and with the common boundary line of the said Campbell and Murdock parcels of land. N. 40 deg. 57′ W. 196.39 feet to a rebar (called for), being a corner of the said Campbell and Murdock parcels of land. Thence leaving the corner to Murdock and with the line of the Campbell parcel of land: N. 57 deg. 58′ E. 96.16 feet to a point, a new corner, (reference 5.06 feet from the said Barker (MP47-/FR1429) parcel of land). Thence with a new line through the Basil & Brenda Campbell (MP.27-FR1383) parcel of land; S. 40 deg. 57′ E. 201.80 feet to a point, a new corner on the R/W of W. Va. Sec. Rte. 18. (referenced 5.00 feet from the said Barker parcel of land). Thence with the R/W of the said W. Va. Sec. Rte. 18. the following courses: S. 48 deg. 48′ W. 28.10 feet to a rebar (called for), thence with a curve having chord bearing of; S. 81 deg. 13′ W. 43.03 feet to a rebar (called for), thence; S. 73 deg. 39′ W. 27.31 feet to the point of beginning, containing 0.444 acres, more or less, as calculated by Engineering Services, Inc., Beckley, WV. And being part of the same property conveyed unto Jane A. Newton, unmarried, by Brenda Campbell and Basil Campbell, her husband, by deed dated June 1996 and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 95, at page 698. This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate. The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. Pursuant to the terms of said deed of trust, the Substitute Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale. The West Virginia Housing Development Fund or its designee may purchase the property at any sale. The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
