NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated July 15, 2003, executed by the Borrowers, Arlie G. Wilson and Kathy J. Wilson, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5010, at Page 1871. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 125 Taylor Street, Crab Orchard, WV 25827. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated July 20, 2016, of record in the Clerk’s Office in Book 5062, at Page 8698. The Borrowers defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date: October 11, 2016 at 1:02 p.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Town District, Raleigh County, West Virginia, and being more particularly described as follows: The surface of that certain tract or parcel of real estate, together with the improvements thereon and appurtenances thereunto belonging, situate and being in Green Valley Homesites, Town District, Raleigh County, West Virginia, and being more particularly bounded and described as follows: TRACT ONE: Said lot is designated as Lot No. 35 in Section No. 1, on a map of said Green Valley Homesites, a copy of which is filed in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Map Book No. 8, at page 8, and reference is hereby made to said map for a more complete description of the property herein conveyed. TRACT TWO: Said lots are designated as Lot Nos. 36, 37 and 38 of Section 1 of Green Valley Homesites, a copy of which map is on file in said Clerk’s office in Map Book No. 8, at page 8. Being the same property conveyed to Arlie G. Wilson, Jr. and Kathy J. Wilson, husband and wife, by a deed from Ida Faye Stillman, single, dated the 22nd day of June, 1993 and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia on Microfilm Roll 41, at page 2844. There is EXCEPTED and RESERVED from this conveyance a portion of Lot No. 38, Section 1, heretofore conveyed by Jerry Lynn Smith and Polly Ann Smith to James G. Anderson, III, and F. Alfred Sines, Jr., by deed dated February 1, 1975, and of record in the aforesaid Clerk’s Office in Deed Book 548, at page 670, said portion of Lot No. 38 being more particularly described as follows: BEGINNING at a point, a corner common to Taylor Street and Lot No. 39; thence S. 80 degrees 23′ E. 152.05 to a point; thence S. 10 degrees 00′ W. 10.00 feet to a point; thence N. 88 25′ W. 138.19 feet to a point; thence N. 17 degrees 42′ W. 33.00 feet to the point and place of BEGINNING, as shown on a map entitled “Map of Lot No. 39 and Part of Lot No. 38, Section 1, Green Valley Homesites, Crab Orchard, Raleigh County, West Virginia, by James E. Cook, R.P.E., January 27, 1975, Scale 1″ = 20′”, marked “From Jerry Smith to Anderson and Sines”, which said map is attached to the deed of record in the aforesaid Clerk’s Office in Deed Book 548, at page 670. Being the same property conveyed to Arlie G. Wilson and Kathy J. Wilson by the Deed dated June 22, 1993 and recorded in Deed Book 41 at Page 2844 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code c 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
