NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated April 6, 2011, executed by Borrower, Judith C. Mullins, to Kevin Moffatt, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5042, at Page 7821. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1878 Stanaford Rd, Beckley, WV 25801-8616. Pill & Pill, PLLC was appointed as Substitute Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 6, 2016, of record in the Clerk’s Office in Book 5063, at Page 5730. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustee hasbeen instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date: November 17, 2016 at 1:17 p.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Town District, Raleigh County, West Virginia, and being more particularly described as follows: The surface of that certain lot or parcel of land, situate in Town District, Raleigh County, West Virginia, particularly bounded and described as follows: Beginning at a found 5/8″ rebar, said point being on the right-of-way of W.Va. Rte 41 (70′ R/W) and on the line of Philip Mark Gillespie, R 156/Pg 1831, a corner to Lots 13 and 14, thence with said Gillespie; S 54 f 51′ E. 224.84 feet to a set 5/8″ rebar, said point being a new corner to Parcel 1 on the line of Lots 13 and 14, thence leaving aforesaid Lot 14 and through said Gillespie Lots 13, 12 & 11; S 35 f 45′ W. 207.22′ feet to a set 5/8″ rebar, said point being on the R/W of a new 40′ R/W, thence with said R/W N 54 f 15′ W to a found 5/8″ rebar, said point being on the R/W of W.Va. Rte. 41 (70′ R/W), thence with said R/W N 35 f 45′ E. 207.22 feet to the point of beginning and containing 1.07 acres, more or less. There is EXCEPTED and RESERVED, from the 1.07 acre tract, of which the 1.03 acre tract is a part of, the following 1.03 acre tract, conveyed unto Toby Harrah and Dolly Harrah, by deed dated March 28, 2006, from Scott D. Va., thence leaving said lot 12 and with said Lot 13 and said R/W; N 35 f 45′ W, 200.0 feet to a point, said point being on the R/W of aforesaid Rte 41 and on the R/W of Rachel Lane, W. Va. Sec. Rte 41/13, 40′ R/W, thence leaving aforesaid Rte 41 R/W and with said Sec. Rte 41/13; S 54 f 15′ E, 224.84 feet to a point, thence leaving aforesaid Sec. Rte 41/13 R/W and through aforesaid lot 14; S 35 f 45′ W, 200.0 feet to a found 5/8″ rebar, said point being on the line of aforesaid Lot 12, thence with said Lot 12; N 54 f 15′ W, 224.84 feet to the point of beginning and containing 1.03 acres more or less. This conveyance is subject to a 40 foot right of way for the purpose of ingress and egress as shown on a map entitled” Property Survey of Parcel 1 of Lots 11, 12 & 13 of the Piney View Farms Situate in Piney View, WV, dated August 10, 2004, and surveyed by ProLine Surveying, Inc.” And being the same property acquired by Judith C. Mullins, by Deed dated April 6, 2011, from Jerrod M. Jones and Cassie L. Jones, to be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, prior to or simultaneously herewith. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code c 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
