NOTICE OF  TRUSTEE’S SALE
Notice is hereby given that by virtue of that certain Deed of Trust dated September 23, 2003, executed by Freddie W. Hedrick Sr. and Deloris J. Hedrick, married, unto J. Michael Anderson, Substitute Trustee,  of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Trust Deed Book 514 at Page 659, the makers of the Note and obligation secured thereby having failed to pay the same as provided for under the terms of said Note and Deed of Trust, and default not cured within the terms of said note and Deed of Trust, the holder of the Note having declared the whole thereof to be due and payable and having requested the undersigned, in writing, to make sale of the real estate described in said Deed of Trust, I will sell at public auction to the highest bidder on January 3, 2017, at 9:30 a.m. of that day at the front door of the Courthouse of Greenbrier County,   Lewisburg, West Virginia, the following described real estate, to-wit:
A certain tract or parcel of property situated in Meadow Bluff District, Greenbrier County, West Virginia and lying on the north side of WV SLS 8 and being more particularly described as follows:
BEGINNING at a ½” rebar and a cap set on the northern right of way of WV SLS 8, said rebar bears N. 07 51′ 12″ W., 11.19 feet to a 31″ bur oak, said rebar corner to Helen Brackenrich; thence leaving said Brackenrich and with the northern right of way of WV  SLS 8 N. 74 40′ 30″ W., 9.21 feet to a point on said right of way; thence with a curve to the left with a delta angle of 32 11′ 11″ and a radius 391.44 feet and a chord bearing of S. 89 13′ 55″ W., 217.02 feet to a point on said right of way; thence S 73 08′ 19″ W., 27.29 feet to a 1/2″, rebar and cap set on the northern right of way of WV SLS 8; thence leaving said WV SLS 8 and through the survey with new division lines N. 22 53′ 28″ W., 207.91 feet to a 1/2″, rebar/cap set; thence N. 05 57′ 46″ W., 90.91 feet to a 1/2″ rebar/cap set; thence N. 35 21′ 33″ W., 154.19 feet to a 1/2″ rebar/cap set; thence N. 72 11′ 36″ W.; 165.14 feet to a 1/2″rebar/cap set; thence N. 74 11′ 59″ W., 200.35 feet to a 1/2″ rebar/cap set; thence S. 10 53’54” W., 31.20 feet to a 1/2″rebar/cap set; thence S. 75 50″ 48″ W., 170.00 feet to a 1/2″ rebar/cap set; thence S. 46 15′ 34″ W. , 446.03 feet to a 1/2″ rear/cap set; thence N. 81 16′ 40″ W., 123.68 feet to a 1/2″ rebar/cap set; thence N. 49 07′ 58″ W., 233.29 feet to a 1/2′ rebar/cap set; thence N. 65 01′ 17″ W., 294.53 feet to a 1/2″ rebar/cap set on the outside line of survey in a fence line and also on the line of Myrna C. McAlex; thence with said McAlex N. 46 04′ 20″ E., 170.98 feet to a 1/2″ rebar/cap set in a fence on the line of said McAlex; thence leaving said McAlex and continuing through the survey with new division lines N. 69 38′ 34″ E., 405.74 feet to a 1/2″ rebar/cap set thence S. 81 31′ 18″ E., 502.25 feet to a 1/2″ rebar/cap set; thence N. 17 25′ 36′ E., 336.14 feet to a 1/2″ rebar/cap set; thence N. 79 29′ 03″ E., 126.67 feet to a 1/2″ rebar/cap set; thence N. 19 52′ 23″ E., 55.91 feet to a 1/2″ rebar/cap set; thence N. 69 12′ 27″ E., 304.47 feet to a 1/2″ rebar/cap set; thence N. 48 47′ 11″ E., 272.15 feet to a 1/2″ rebar/cap set; thence S 81 47′ 12″ E., 270.66 feet to a 1/2″ rebar/cap set in a fence line on the line of David M. Moore; thence with said fence line and siad Moore in part and Helen Brackenrich in part S. 08 12′ 52″ W., 1263.37 feet to the   BEGINNING and containing 24.84 acres, more or less as surveyed by  Brackenrich & Associates, Inc., in July of 1996 and shown upon a plat entitled “Plat of Survey for WV Farm Service Agency.”
And Being a part of the same property conveyed unto Freddie W. Hedrick and Deloris J. Hedrick, his wife, from U.S.A., by the FSA, by Billy B. Burke, St. Exec Dir., by deed dated July 29, 1996 and recorded in the office of the Clerk of the County Commission of Greenbrier County, West Virginia in Deed Book 439 at Page 250.
THERE IS FURTHER RESERVED AND EXCEPTED the following out-sales:
1. Conveyance of 2.00 acres from Freddie W. Hedrick, Sr. and Deloris J. Hedrick, his wife, to Kirby Blankenship and his wife, recorded in Deed Book 447 at Page 523.
2. Conveyance of 2.00 acres and a right of way from Freddie W. Hedrick, Sr. and Deloris J. Hedrick, his wife, to John Withrow and his wife, recorded in Deed Book 447 at Page 811.
3. Conveyance of 2.00 acres and a right of way from Freddie W. Hedrick, Sr. and Deloris J. Hedrick, his wife, to Steven R. Truman  and his wife, recorded in Deed Book 448 at Page 354.
4. Conveyance of 1.00  from Freddie W. Hedrick, Sr. and Deloris J. Hedrick, his wife, to Ricky W. O’Dell   and his wife, recorded in Deed Book 448 at Page 131.
5. Conveyance of 2.00 acres  from Freddie W. Hedrick, Sr. and Deloris J. Hedrick, his wife, to Michael K. Goddard and his wife, recorded in Deed Book 449 at Page19. Later a Deed
of Correction was filed in Deed Book 449 at page 615.
6. Conveyance of 2.00  and right of way from  Freddie W. Hedrick, Sr. and Deloris J. Hedrick, his wife, to Dustin S. Griffith, et al.,   recorded in Deed Book 449 at Page 613.
7. Conveyance of 76.982 acres    and 24.840 acres from  Freddie W. Hedrick, Sr. and Deloris J. Hedrick, his wife, to David  Lumsden and his wife,   recorded in Deed Book 454 at Page 09.
8. Conveyance of 6.279 acres  from  Freddie W. Hedrick, Sr. and Deloris J. Hedrick, his wife, to Ricky Hunter and his wife,   recorded in Deed Book 460 at Page 355.
TERMS OF SALE: Cash in hand paid on day of sale subject to all unpaid property taxes, restrictive covenants, reservations, and easements.
