NOTICE OF TRUSTEE’S SALE Under authority of that certain Deed of Trust dated October 21, 2009, from Frederick A. Perry, II to Casie McGee, Trustee, of record in the office of the Clerk of the County Commission of Fayette County, West Virginia in Trust Deed Book No. 850, at page 248, securing a promissory note in the principal amount of $86,813.72, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made pursuant to the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Substitute Trustee will offer for sale at the front door of the Fayette County Courthouse in Fayetteville, West Virginia on April 29, 2015 at 3:15 p.m., subject to all reservations, exceptions, easements and other matters which appear of record and subject to all unpaid taxes, if any, all that certain surface tract or parcel of real estate, together with the improvements thereon, situate in on the waters of Dempsey Branch, along Route 8/1, New Haven District, Fayette County, West Virginia, which property is more particularly bounded and described as follows: Beginning at a point in the center of Dempsey Branch corner to the Doggett Chapel lot owned by Methodist Church South (DB G, page 561) and corner to the Perry Bonding, Inc. Tract (DB 546, page 84), of which this is a part; thence, leaving Dempsey Branch crossing Route 8/1 and with the Doggett Chapel lot, S 37 f 48′ 00″ E, passing a 5/8″ rebar (found) at 13.50′ and 174.63′, for a total distance of 345.76′, to a lead plug (set); thence S 69 f 49′ 16″ W a distance of 304.62′, to a 5/8″ capped rebar (set); thence N 37 f 47′ 28″ W, re-crossing Route 8/1 and passing a 5/8″ capped rebar (set) at 338.01′, for a total distance of 351.34′, to a point in Dempsey Branch; thence with said branch the following seven courses and distances, N 68 f 06′ 20″ E a distance of 48.52′; thence N 60 f 26′ 28″ E a distance of 60.01′; thence N 67 f 21′ 05″ E a distance of 57.09′; thence N 75 f 48′ 26″ E a distance of 63.06′; thence N 86 f 13′ 46″ E a distance of 34.84′; thence N 78 f 17′ 30″ E a distance of 22.46′; thence N 68 f 05′ 42″ E a distance of 23.17′; to the point of beginning, having an area of 103,620 square feet, or 2.38 acres, more or less. All bearings based on the magnetic meridian of 1982, having a declination of 5 f 09′ west. Being the same property conveyed from Perry Bonding, Inc. to Frederick A. Perry, II by Deed dated September 20, 2009, of record in the aforesaid Clerk’s office in Deed Book No. 652, at page 381. Terms of the sale: cash on date of sale.
