NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Richard A. Pill, David D. Pill, and Amanda E. Steiner, any of whom may act, by that certain Deed of Trust dated May 16, 2007, executed by Borrower Shirley M. Elswick Jr, to Janet Phillips, the Trustee of record in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Book 796, at Page 238. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 341 Pierce Street, Fayetteville, WV 25840. Richard A. Pill, David D. Pill, and Amanda E. Steiner were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 28, 2015, of record in the Clerk’s Office in Book 945, Page 143. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Fayette County, in Fayetteville, West Virginia, on the following date: May 1, 2015 at 11:00 a.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Fayetteville District, Fayette County, West Virginia, and being more particularly described as follows: BEGINNING at a 1/2″ rebar (set) at the common corner of the tract hereinafter described and the Fayetteville Municipal Water Works (DB 395/369) tract on the western edge of Pierce Street; thence S 48-57-22 W 179.00 feet to a 1/2″ rebar set; thence N 31-15-13 W 221.70 feet to a 1/2″ rebar (set); thence N 48-30-13 E 207.00′ to a roof bolt (found) (disturbed) at the common corner of the E. G. Hinman 1.4 acre parcel situate on the western edge of Pierce Street; thence with Pierce Street S 24-25-33 E 229.70 feet to the point of Beginning and containing 0.971 acre and more particularly shown on the certain “Plat of Survey Showing A 0.971 Acre Tract For Timothy G. Lightner Situate in Fayetteville Corporation New Haven District, Fayette County, West Virginia Scale: 1″ = 50′ July, 1999”. Being the same property conveyed to Shirley M. Elswick Jr by the Deed dated April 22, 2002 and recorded in Deed Book 585, at Page 653 in the Office of the Clerk of the County Commission of Fayette County, West Virginia.
