NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE`S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustees, Richard A. Pill, David D. Pill, and Amanda E. Steiner, any of whom may act, by that certain Deed of Trust dated December 22, 2005, executed by Borrower, Sherry Hubbard, to Seneca Trustees, Inc., the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5020, at Page 4716. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 107 Mathis Drive, Daniels, WV 25832. Richard A. Pill, David D. Pill, and Amanda E. Steiner were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 6, 2014, of record in the Clerk`s Office in Book 5057 at Page 1343. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date: WEDNESDAY, JANUARY 14, 2015 AT 10:00 A.M. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Shady Springs District, Raleigh County, West Virginia, and being more particularly described as follows: The following hereinafter described lots or parcels of land, with any appurtenances thereunto belonging, situate in Shady Springs District, Raleigh County, West Virginia, bounded and described as follows; FIRST: BEGINNING at a stake which is 189 feet south of the old Giles, Fayette and Kanawha Turnpike in the line of Lot No. 2 and Lot No. 3, Section 1, of the Lewis Subdivision; thence with the dividing line between Lots 2 and 3, S. 74 degrees 49′ W. 1555.51 feet to a stake; thence leaving Lot No. 2 and running with the outside line of the Lewis Subdivision N. 4 degrees 07′ E. 185.42 feet to a stake, corner of Lot No. 4, Section 1 of the Lewis Subdivision; thence with said Lot No. 4 N. 74 degrees 49′ E. 1475.10 feet to a stake; thence leaving the line of Lot No. 4, now owned by Joe Price, and through the lands of Mamie Bibey in a southerly direction, 5. 21 degrees 25′ E. 176.04 feet to a stake, the point of beginning, and containing 6.0 acres, more or less. SECOND: An easement twenty (20) feet wide over, through and upon the lands of the said Joe Price and Mamie Bibey, more particularly described as follows: BEGINNING at the old Giles, Fayette and Kanawha Turnpike and extending over the lands of Joe Price to a point 57 feet from the edge of the old Giles, Fayette and Kanawha Turnpike; thence leaving the lands of Joe Price and still continuing 20 feet wide over, through and upon the lands of Mamie Bibey, S. 74 degrees 49′ W. 144 feet to the tract described “FIRST’ in this deed, and this easement shall be for the purpose of unlimited ingress and egress to the tract described “FIRST” hereinabove set out and herein conveyed for the use of the party of the second part, their heirs and assigns forever. The said party of the first part does further GRANT unto the said party of the second part, for the use and benefit of the six (6) acres, more or less herein conveyed, an easement over, through and upon a 0.82 acre tract of land which was formerly owned by Mamie Bibey, which said easement shall permit the said party of the second part full ingress and egress to the water meter and gas meter located upon the lands of the said Mamie Bibey; and being the easement which was granted to Ernest F. Clark and Chessie F. Clark by deed dated the 28th day of April, 1972, recorded in Deed Book 511, at page 234. Being the same property conveyed to Charles P. Hubbard and Sherry Hubbard, his wife, by a deed from Chessie F. Clark, single, dated the 14th day of July, 1981 and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 646, at page 530. And being the same property conveyed to Sherry Hubbard, former wife of Charles P. Hubbard, by a deed from Charles P. Hubbard, single, former husband of Sherry Hubbard, dated the 26th day of June, 1998 and recorded in the aforesaid Clerk’s Office on Microfilm Roll 137, at page 75. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code c 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee by certified or cashier’s check within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
