NOTICE OF TRUSTEE’S SALE
Notice is hereby given that the undersigned, Robert D. Berryman, Trustee, under that certain deed of trust executed by Wayne D. Swindle, Jr., dated February 15, 2019, securing Superior Properties, LLC, a West Virginia limited liability company, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Trust Deed Book 1216, at page 816, will offer for sale at public auction to the highest responsible bidder, at the front door of the Marion County Courthouse, Fairmont, Marion County, West Virginia, on the 30th day of September, 2019, at 11:15 a.m., all the following described lots or parcels of real estate, together with the improvements thereon and appurtenances thereunto belonging, situate, lying and being in City of Fairmont District, Marion County, West Virginia, West Virginia, and being more particularly described as follows:
TRACT ONE:
PARCEL NO. 1: Beginning at a stake at the Fairmont & Morgantown Turnpike (Pennsylvania Avenue), corner to lot of Angelo Viani, and running thence with line of same, S.W. 120 feet to a stake; thence running across the lot of Charles O. Parker and Rebecca N. Parker, his wife, a line parallel with the line of the Simon Addition property, N. 29 1/2º W. 35 feet to a stake; thence running toward said Pennsylvania Avenue, N.E. 120 feet to the line of said Fairmont and Morgantown Turnpike; and thence with line of same a distance of 35 feet to the place of beginning; being a lot fronting 35 feet on said Pennsylvania Avenue and extending back therefrom in a uniform width of 35 feet for a distance of 120 feet. (Previously designated as Parcel No. 1 in Deed Book 914, at page 749).
PARCEL NO. 2: Beginning at a stake on the Fairmont and Morgantown Turnpike Road (Pennsylvania Avenue), corner to lands formerly owned by Homer C. Parker and running thence with the line of said property formerly owned by Parker, S.W. 274 feet more or less, to the line of the Simon Addition and corner to said Parker, thence S. 29 1/2º E. 40 feet to corner of an abutting lot, and with the line of said abutting lot N.E. 249 feet more or less, to said Fairmont and Morgantown Turnpike Road (Pennsylvania Avenue) and thence N. 9 1/2º W. 40 feet, to the place of beginning; said parcel fronts 40 feet on Pennsylvania Avenue (formerly Pike Street) and extends back therefrom in a uniform width of 40 feet to the line of Simon Addition. (Previously designated as Parcel No. 3 in Deed Book 914, at page 749).
TRACT TWO:
Beginning at a cut on the concrete walk at the southeastern corner of said long on Pennsylvania Avenue and the property of Mike Cipriano; thence S. 76° W. 192.7 feet to a stake, corner to Rosa Belle Kendall; thence N. 27° 30’ W. 48.6 feet to a stake, corner to Miller estate; thence N. 70° 34’ E. 90.1 feet to a stake; thence N. 11° W. 45 feet to a stake; thence N. 78° 45’ E. 122 feet to a point in concrete walk, corner to Pennsylvania Avenue, and thence S. 08° 15’ E. 95 feet to the place of beginning, as shown on a map or plat made by S. A. Shuttlesworth, Registered Engineer, and dated March 9, 1946.
And Being the same real estate conveyed to Wayne D. Swindle, Jr. by Superior Properties, LLC by Deed dated February 15, 2019 and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1243 at page 639.
Said sale will be “AS IS” and will be without covenant or warranty and will be subject to (i) property taxes; (ii) the tax on the transfer of property and (iii) the liens of the Internal Revenue Service, West Virginia State Tax Department and (iv) claims of the West Virginia State Auditor and to all existing reservations, restrictions, exceptions, conditions, leases, easements, rights-of-way or other servitudes, if any, made, retained or created in prior deeds of record in the chain of title to the property herein described.
The undersigned reserves the right to reject any and all bids and to continue the sale of the real estate from time to time by announcement made at the time of the sale or any continuance thereof.
The undersigned shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining on the property after the foreclosure sale will be deemed to constitute abandoned property and will be disposed of accordingly.
