NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE NOTICE is hereby given that default having been made under the terms of a Deed of Trust dated March 6, 2007, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5026 at page 1489, executed by Conston Williams (aka Conston Williams, Jr.) and Jeffrey A. Williams to Alan R. Terry and Carl W. Roop, Trustees, securing Pioneer Community Bank, which was given to secure the payment of the note therein described, and demand having been made upon the undersigned so to do, the undersigned Trustee, Carl W. Roop will, on the 4th day of June, 2015, at the front door of the Raleigh County Courthouse, in the City of Beckley, West Virginia, at 9:00 a.m., sell the property hereinafter described, which property was conveyed in said deed of trust, and being more particularly described as follows: Those two (2) parcels of realty, in or near to the Town of Bradley, in Town District, Raleigh County, West Virginia, more particularly located, bounded and described as follows: PARCEL 1: Being a tract of approximately 1.82 acres, more or less, the remaining portion of that certain parcel containing approximately 6.27 acres, more or less, deeded to Nancy J. Williams by Henry Davis and Nealy F. Davis, his wife, by Deed dated June 11, 1929, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 104 at Page 73. During her lifetime, said Nancy J. Williams conveyed parts and portions of said parcel to W. T. Sexton and Carl Bryant, and to Georgia Pearl Williams and Conston Williams, her husband. What was then left, she willed and devised to said Georgia Pearl Williams and Conston Williams by her Last Will and Testament, dated September 26, 1968 and recorded in said Clerk’s Office in Will Book 15 at Page 236. During the lifetime of said Conston Williams, he and his wife, said Georgia Pearl Williams, conveyed parts and portions of said parcel to Shirley and Alice Ball, by Deed dated June 30, 1970 and recorded in said Clerk’s Office in Deed Book 489 at Page 292. What was yet remaining, after the aforementioned off-conveyances, was owned in equal portions by said Conston Williams and his wife, said Georgia Pearl Williams, at the time he died, intestate, December 5, 1974, and his portion descended to and was inherited by his heirs at law, his wife, Georgia Pearl Williams, and his eleven (11) children, whose names are as follows: Elizabeth Rose Loudermilk, whose husband is Richard Loudermilk; Franklin Lawson Williams, whose wife is Peggy Ann Williams; Janet Lou Gill, whose husband is Paul Edward Gill; Betty Sue Massey, whose husband is Charles Walter Massey; Conston Williams, Jr., who is divorced and unmarried; Kenneth Lawarence Williams, whose wife is Letha Lyn Williams; Denny Ray Williams, whose wife is Drema Kay Williams, Brenda Gail Williams, who is divorced and unmarried; Gary Wayne Williams, whose wife is Cindy Rae Williams; Sherry Lea Legg, whose husband is Ronald Keith Legg; and Jeffrey Alan Williams, who is single. PARCEL 2: Being a tract, part of a tract conveyed to Nancy J. Williams by Raleigh Loan Company, dated October 4, 1939 and recorded in said Clerk’s Office in Deed Book 168 at Page 280, comprising the whole thereof, less the part thereof deed by said Nancy J. Williams to the Trustees of the Freewill Baptist Church of Maple Fork, West Virginia, and recorded in said Clerk’s Office in Deed Book 305 at Page 2. What yet remained was willed by the aforementioned Nancy J. Williams to the aforementioned Conston Williams and Georgia Pearl Williams, his wife, by the aforementioned will of Nancy J. Williams, and when the aforementioned Conston Williams died, intestate, as herein related, his interest in this parcel likewise descended to and was inherited by his said children. And being the same property Parcel 1 and Parcel 2 conveyed to Jeffrey Alan Williams, by deed dated December 18, 2006, from Denny Rae Williams and Drema Kay Williams, husband and wife, Brenda Dow, single, Elizabeth Rose Loudermilk and Richard Loudermilk, husband and wife Franklin Lawson Williams and Peggy Ann Williams, husband and wife, Janet Lou Gill, single, Betty Sue Massey and Charles Walter Massey, husband and wife, Conston Williams, Jr., single, Kenneth Lawarence Williams and Letha Lyn Williams, husband and wife, Gary Wayne Williams and Cindy Rae Williams, husband and wife, Sherry Lea Legg and Ronald Keith Legg, husband and wife, and Jeffrey Alan Williams, married, and is recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5025, at page 4693. PARCEL 3: The surface of that certain tract or parcel of land situate in Town Tax District, Raleigh County, West Virginia, and being more particularly described as follows to-wit Situated on the North side of Maple Fork hard road. BEGINNING at a corner of the property of Carl Stover; thence in an Eastern direction with said hard road, 60 feet to a stake, a new made corner; thence in a Northern direction 63 feet to a gate post, a new made corner; thence in a Western direction, with a new line (different from the line called for in Deed Book 289, at page 511, from Nancy Williams to Conston Williams) 145 feet, more or less, to a new point in the line of Conston Williams, and which new point is 32 feet in a Northerly direction from the gate post of Carl Stover; thence South with said Williams line, 32 feet to said gate post of Carl Stover; thence in an Eastern direction with said Stover line 50 feet to a post, a corner; thence in a Southern direction with said Stover line 60 feet to the point of BEGINNING, containing one-fifth (1/5) acre, more or less; and which said tract or parcel of land is shown and designated upon the Raleigh County Assessor’s Tax Map for Town Tax District number 4A, as Parcel No. 56. And being the same interest in real estate conveyed to Jeffrey A. Williams by deed dated December 9, 1987, by Georgia Williams, unmarried and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 728, at Page 730. PARCEL 4: The surface of that certain tract or parcel of land situate in Town Tax District, Raleigh County, West Virginia, and being more particularly bounded and described as follows, to-wit: BEGINNING at a stake which is situate on the Northern right of way line of the Maple Fork Road, and which said stake is situate 60 feet from the common corner of Carl Stover and that certain lot or parcel of land heretofore conveyed to Andy Szincsak and subsequently re-conveyed to the party of the first part; thence from said beginning stake with the line of the lot heretofore conveyed to Andy Szincsak and reconveyed to the party of the first part, in a Northerly direction 79 feet to the Southwestern corner of that certain tract heretofore conveyed by the party of the first part unto the party of the second part herein, as his residence property; thence with the front boundary line of the said residence property, in an Easterly direction, 50 feet, and continuing in a straight line on a new course, in an Easterly direction, as aforesaid, through the lands of the party of the first part, for a total distance of 61 feet; thence in a Southerly direction 51 feet to a point on the Northern right of way line of the said Maple Fork Road, which said point is 67 feet East of the beginning stake; thence with said Northern right of way line, in a Westerly direction, 67 feet to the point of BEGINNING; and which said tract or parcel of land is shown and designated upon the Raleigh County Assessor’s Tax Map for Town Tax District numbered 4, as Parcel No. 21.2 incorrectly listed as Parcel No. 20.2. And being the same property heretofore acquired by James A. Williams from Georgie Williams, by deed dated April 4, 1986 and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 715, at Page 407. And further being the same property conveyed to Conston Williams by deed dated the 9th day of February, 2007 from Jeffrey A. Williams, which said Deed is recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5026 at page 1479. Said property will be sold upon the following terms and conditions: 1. Cash in hand on day of sale. 2. The property will be conveyed in an “AS IS” condition by Deed containing Special Warranty of Title, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, validly enforceable prior liens, reservations, encumbrances, restrictions, right-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 3. The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4. The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, or remove any personal property and/or belongings remaining at the property. 6. The purchaser(s) at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property. 7. In the event there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
