NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described, and the undersigned having been required so to do by the owner and holder of said indebtedness, the undersigned Substitute Trustee {see General Lien Book No. 1862, at page 275 thereof} will offer for sale at the front door of the Wood County Courthouse, Parkersburg, West Virginia, on

at 10:00 o’clock in the

forenoon, local time,

 

at public auction, to the highest bidder for cash, all of the right, title and interest of ROBERT A. NORMAN and ELAINE NORMAN, husband and wife, in and to certain real property described in a certain deed of trust dated June 7, 2001, to RANDALL E. SNIDER and WILLIAM G. POWELL, original Trustees, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in General Lien Book No. 950, at page 608 thereof, possessed by the said ROBERT A. NORMAN and ELAINE NORMAN as at the making of said deed of trust, which said real estate is described in said deed of trust follows, to-wit:

 

All that certain lot, tract or parcel of real estate situate, lying and being in the City of Parkersburg, County of Wood, and State of West Virginia, more particularly bounded and described as follows:

 

FIRST TRACT:

BEGINNING at an iron rod in the westerly line of Cypress Street, said point being the common corner of Lots 74 and 75 of Camden Farms Addition No. 2, as shown in Plat Book 2, Page 51, in the Office of the Clerk of the County Commission of Wood County, West Virginia; thence with the common line of Lots No. 74 and 75 N. 70õ 00’ W. 193.71 feet to an iron rod; thence N. 18õ 25’ 20ã E. 70.04 feet to an iron rod; thence S. 70õ 00’ E. 25.52 feet to a point; thence S. 70õ 00’ 00ã E. 22.21 feet to a point; thence S. 18õ 25’ 20ã W. 5.00 feet to a point; thence S. 70õ 00’ 00ã E. 147.91 feet to a point in the westerly line of Cypress Street; thence with the westerly line of Cypress Street S. 20õ 00’ 00ã W. 70.00 feet to the place of beginning, containing 13,741 square feet, and being part of the aforesaid Lot No. 75, as more particularly shown on a plat of survey prepared by James L. DeBruIar, L.L.S., dated August 17, 1999, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book _____ at Page _____.

 

BEING the same real estate conveyed to ROBERT A. NORMAN and G. ELAINE NORMAN, husband and wife, by BETTY J. FARNSWORTH and GILBERT L. FARNSWORTH, her husband, by deed dated January 7, 1997, and of record in the aforesaid Clerk’s Office in Deed Book 963 at page 819 and Deed Book 1002 at page 577.

 

SECOND TRACT:

BEGINNING at an iron rod in the westerly line of Cypress Street, said point being the common corner of Lots 75 and 76 of Camden Farms Addition No. 2 as shown in Plat Book 2, Page 51; thence with the westerly line of Cypress Street S 20õ 00’ 00ã W. 30 feet to a point; thence N. 70õ 00’ 00ã W. 147.91 feet to a point; thence N. 18õ 25’ 20ã E. 5.00 feet to a point; thence N. 70õ 00’ 00ã W. 22.21 feet to a point; thence S. 18õ 25’ 20ã W. 5.00 feet to a point; thence N. 70õ 00’ 00ã W. 25.52 feet to a point; thence S,. 18õ 25’ 20ã W. 70.04 feet to an iron rod in the common line of Lots 74 and 75 of Camden Farms Addition No. 2; thence with the common line of Lots 74 and 75 N. 70õ 00’ 00ã W. 222.29 feet to an iron rod; thence N. 20õ 00’ 00ã E. 100.00 feet to an iron rod at the common corner of Lots 75 and 76; thence with the common line of Lots 75 and 76 S. 70õ 00’ 00ã E. 416.00 feet to the place of beginning, containing 27,859 square feet, and being part of the aforesaid Lot No. 75, as more particularly shown on a plat of survey prepared by James L. DeBruIar, L.L.S., dated August 17, 1999, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book _____ at Page _____.

 

BEING the same real estate conveyed to ROBERT A. NORMAN and G. ELAINE NORMAN, husband and wife, by BETTY J. FARNSWORTH and GILBERT L. FARNSWORTH, her husband, by deed dated January 7, 1997, and of record in the aforesaid Clerk’s Office in Deed Book 963 at page 819 and Deed Book 1002, at page 575.

 

This conveyance is subject to all easements, rights of way, restrictions, reservations and protective covenants, including but not limited to oil, gas and mineral reservations, exceptions and leases appearing in the chain of title.

 

AND believed to have a street address of 4309 and 4309 1/2 Cypress Street, Parkersburg, West Virginia,

upon the following terms to-wit:

  1. $5,000.00 in cash or certified funds per tract of land at sale, with balance due within 10 days or as the Trustee and bidder(s) may otherwise agree at sale.
  2. Subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantors and their predecessors in title prior to the granting of the deed of trust being foreclosed upon.
  3. The undersigned reserves the right to adjourn the sale from day to day and time to time upon oral proclamation made at the time and place of sale set forth herein or at such later time and place to which the sale has theretofore been adjourned.
  4. The undersigned reserves the right to reject any and all bids.
  5. Sale is subject to unpaid ad valorem taxes and special assessments, if any, as well as any sale of the subject real estate for unpaid taxes.
  6. The premises described hereinabove, including any and all improvements thereto, are sold âAS IS-WHERE ISã with no warranty express or implied.
  7. The owner and holder of the indebtedness secured by the deed of trust described hereinabove reserves the right to bid at this sale.
  8. The successful buyer at the sale will be responsible for paying any and all transfer stamps, excise fees and recording costs with respect to the trustee’s deed.
  9. Neither the owner and holder of the indebtedness secured by the underlying deed of trust nor the substitute trustee shall have any duty to cause any existing tenant or person or persons occupying the subject property to vacate said property.
  10. Sale is subject to the provisions of W.Va. Code Œ38-1-16 regarding any existing tenancy.
  11. Sale is subject to the right of the Internal Revenue Service to redeem the subject real estate within 120 days following the sale. See 26 U.S.C. Œ7425.
  12. Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the successful bidder’s or bidders’ discretion. Any person or entity claiming ownership of or any interest in any such property should contact the undersigned prior to sale about any such claim.
  13. The successful bidder at the sale and the Trustee shall execute a Memorandum of Sale at the conclusion of the sale, and the terms of the Memorandum shall control.
  14. In the event that the successful bidder at the sale fails or refuses to consummate his, her, its or their purchase, then the Trustee shall have the option to consummate sale with the next highest bidder at the sale.
  15. The undersigned reserves the right to sell the above-referenced tracts of land separately or together.
