NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE NOTICE IS HEREBY GIVEN that the undersigned Trustee, by virtue of the authority vested in her by that certain Deed of Trust dated October 1, 2018, duly recorded in the Office of the Clerk of the County Commission of Harrison County, West Virginia, in Trust Deed Book No. 1390, at page 635, Shari D. Smiers did convey unto Mary L. Robinson, Trustee, certain real property described in said Deed of Trust; and default having been made in the payment of the aforesaid indebtedness, and the undersigned Trustee having been requested in writing so to do by the Lender, Harrison County Bank, the owner and holder of said note, the undersigned Trustee, will on, SEPTEMBER 1, 2020 AT 10:00 A.M. OFFER FOR SALE AND SELL AT PUBLIC AUCTION at the front door of the Courthouse of Harrison County, West Virginia, to the highest bidder therefor, the following real estate, to wit: All that certain lot or parcel of land, together with all buildings and improvements thereon and appurtenances thereunto belonging, situate at the intersection of Watson Street and North Faris Avenue, Bridgeport, Simpson District, Harrison County, West Virginia, being part of Lot No. Twenty-Nine (29), as laid down and designated upon the plat entitled “Second Revised Plat No. Subdivision Faris Acres Addition to Town of Bridgeport”, dated April, 1953, and recorded in the Office of the Clerk of the County Commission of Harrison County, West Virginia, in Deed Book No. 747, at pages 218 and 219, and more particularly bounded and described as follows: Beginning at a stake at the southeasterly corner to Lot No. 29, being the northwesterly point of intersection of Watson Street and North Faris Avenue, and running thence with the northerly line of Watson Street, S. 63 24′ W. 106.08 feet to a stake in the easterly line of the westerly part of Lot No. 29, heretofore conveyed by Alfred L. Hamilton and Julia E. Hamilton, his wife, to Charles D. McMullen and June L. McMullen, his wife, by Deed dated the 11th day of February, 1958, of record in aforesaid County Clerk’s Office in Deed Book No. 805, at page 279; thence therewith N. 11 26′ W. 106.06 feet to a stake in the northerly line of said Lot No. 29; thence therewith N. 78 34′ E. 102.37 feet to a stake in the westerly line of North Faris Avenue; and thence therewith S. 11 26′ E. 78.3 feet to the beginning. Being the same lots or parcels of land conveyed unto Shari Denise Smiers from Shana J. Carpenter, by deed dated May 31, 2018 and recorded in the Office of the Clerk of the County Commission of Harrison County, West Virginia, in Deed Book No. 1616, at page 1102. The aforesaid property will be sold subject to all exceptions, reservations, restrictions, covenants and conditions contained as in prior deeds conveying said property and subject to any and all unpaid taxes assessed against said property. The above described real estate is reported to have a mailing address of: 201 Faris Avenue, Bridgeport, WV 26330. TERMS OF SALE; The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the aforesaid Clerk’s office or affecting the subject property.. All real estate taxes currently due or hereafter due will be the responsibility of the buyer. The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. The Beneficiary/and or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. The total purchase price is payable to the Trustee by certified or cashier’s check within thirty (30) days of the sale, with ten percent (10%) of the total purchase price payable to the Trustee at sale by certified or cashier’s check. Title will be conveyed by Trustee’s Deed upon payment of the balance. Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry.
